On
October 27, 2009, representatives of the
Phase I claimant categories (the ‘‘Phase
I Claimants’’) 1 filed with the Judges a
motion requesting a partial distribution
of 50% of the 2004, 2005, 2006, and
2007 satellite royalty funds pursuant to
section 801(b)(3)(C) of the Copyright
Act. That section requires that the
Judges publish a notice in the Federal
Register seeking responses to the
motion for partial distribution to
ascertain whether any claimant entitled
to receive such fees has a reasonable
objection to the requested distribution
before ruling on the motion.
Consequently, by today’s Notice, the
Judges seek comments from interested
claimants on whether any reasonable
objection exists that would preclude the
distribution of 50% of the 2004, 2005,
2006 and 2007 satellite royalty funds to
the Phase I claimants.

AGENCY:
SUMMARY: The National Archives and
Records Administration (NARA)
publishes notice at least once monthly
of certain Federal agency requests for
records disposition authority (records
schedules). Once approved by NARA,
records schedules provide mandatory
instructions on what happens to records
when no longer needed for current
Government business. They authorize
the preservation of records of
continuing value in the National
Archives of the United States and the
destruction, after a specified period, of
records lacking administrative, legal,
research, or other value. Notice is
published for records schedules in
which agencies propose to destroy
records not previously authorized for
disposal or reduce the retention period
of records already authorized for
disposal. NARA invites public
comments on such records schedules, as
required by 44 U.S.C. 3303a(a).
DATES: Requests for copies must be
received in writing on or before
February 26, 2010. Once the appraisal of
the records is completed, NARA will
send a copy of the schedule. NARA staff
usually prepare appraisal
memorandums that contain additional
information concerning the records
covered by a proposed schedule. These,
too, may be requested and will be
provided once the appraisal is
completed. Requesters will be given 30
days to submit comments.

Each year
Federal agencies create billions of
records on paper, film, magnetic tape,
and other media. To control this
accumulation, agency records managers
prepare schedules proposing retention
periods for records and submit these
schedules for NARA’s approval, using
the Standard Form (SF) 115, Request for
Records Disposition Authority. These
schedules provide for the timely transfer
into the National Archives of
historically valuable records and
authorize the disposal of all other
records after the agency no longer needs
them to conduct its business. Some
schedules are comprehensive and cover
all the records of an agency or one of its
major subdivisions. Most schedules,
however, cover records of only one
office or program or a few series of
records. Many of these update
previously approved schedules, and
some include records proposed as
permanent.
The schedules listed in this notice are
media neutral unless specified
otherwise. An item in a schedule is
media neutral when the disposition
instructions may be applied to records
regardless of the medium in which the
records are created and maintained.
Items included in schedules submitted
to NARA on or after December 17, 2007,
are media neutral unless the item is
limited to a specific medium. (See 36
CFR 1225.12(e).)
No Federal records are authorized for
destruction without the approval of the
Archivist of the United States. This
approval is granted only after a
thorough consideration of their
administrative use by the agency of
origin, the rights of the Government and
of private persons directly affected by
the Government’s activities, and
whether or not they have historical or
other value.
Besides identifying the Federal
agencies and any subdivisions
requesting disposition authority, this
public notice lists the organizational
unit(s) accumulating the records or
indicates agency-wide applicability in
the case of schedules that cover records
that may be accumulated throughout an
agency. This notice provides the control
number assigned to each schedule, the
total number of schedule items, and the
number of temporary items (the records
proposed for destruction). It also
includes a brief description of the
temporary records. The records
schedule itself contains a full

The U.S. Nuclear Regulatory
Commission (NRC) is considering the
issuance of an Exemption, pursuant to
10 CFR 50.12 and 10 CFR 50.60(b) from
the requirements of 10 CFR 50.61 and
10 CFR part 50, Appendix G for Facility
Operating License Nos. DPR–31 and
DPR–41, issued to Florida Power and
Light Company (the licensee), for
operation of the Turkey Point Units 3
and 4, located in Miami, Florida. In
accordance with 10 CFR 51.21, the NRC
prepared an environmental assessment
documenting its finding. The NRC
concluded that the proposed actions
will have no significant environmental
impact.
Environmental Assessment
Identification of the Proposed Action

The proposed action would exempt
the licensee from certain requirements
of 10 CFR 50.61, ‘‘Fracture Toughness
Requirements for Protection Against
Thermal Shock Events,’’ and 10 CFR
Part 50, Appendix G, ‘‘Fracture
Toughness Requirements.’’
The proposed action is in accordance
with the licensee’s application dated
March 18, 2009.
The Need for the Proposed Action
The proposed exemption would allow
the licensee to use an alternative
method, described in Framatome ANP
Topical Report BAW–2308, Revisions
1–A and 2–A (supplemental), for

determining the adjusted RTNDT
(reference nil-ductility temperature) of
the Linde 80 weld materials present in
the beltline region of the Turkey Point
Units 3 and 4 reactor pressure vessels.
request would result in no change in
current environmental impacts. The
environmental impacts of the proposed
exemption and the ‘‘no action’’
alternative are similar.
Environmental Impacts of the Proposed
Action
Alternative Use of Resources
The NRC has completed its
environmental assessment of the
proposed exemption. The staff
concluded that the change would not
significantly affect plant safety and
would not have a significant adverse
effect on the probability of an accident
occurring. The proposed action would
not result in an increased radiological
hazard beyond those previously
analyzed. There will be no change to
radioactive effluents that effect radiation
exposures to plant workers and
members of the public. The proposed
action will be performed inside existing
plant buildings. No changes will be
made to plant buildings or the site
property. Therefore, no changes or
different types of radiological impacts
are expected as a result of the proposed
exemption.
The proposed action does not result
in changes to land use or water use, or
result in changes to the quality or
quantity of non-radiological effluents.
No changes to the National Pollution
Discharge Elimination System permit
are needed. No effects on the aquatic or
terrestrial habitat in the vicinity or the
plant, or to threatened, endangered, or
protected species under the Endangered
Species Act, or impacts to essential fish
habitat covered by the MagnusonSteven’s Act are expected. There are no
impacts to the air or ambient air quality.
There are no impacts to historical and
cultural resources. There would be no
impact to socioeconomic resources.
Therefore, no changes or different types
of non-radiological environmental
impacts are expected as a result of the
proposed exemption. Accordingly, the
NRC concludes that there are no
significant environmental impacts
associated with the proposed action.
The details of the staff’s safety
evaluation will be provided in the
exemption that will be issued as part of
the letter to the licensee approving the
exemption to the regulation if granted.
Environmental Impacts of the
Alternatives to the Proposed Action
As an alternative to the proposed
actions, the staff considered denial of
the proposed action (i.e., the ‘‘no-action’’

The action does not involve the use of
any different resources than those
considered in the Final Environmental
Statement for the Turkey Point Units 3
and 4, Docket No. 50–250 and 50–251,
issued in 1972.
Agencies and Persons Consulted
In accordance with its stated policy,
on January 6, 2010, the staff consulted
with the Florida State official, Charles
Hamilton of the Bureau of Radiation
Control, regarding the environmental
impact of the proposed action. The State
official had no comments.
Finding of No Significant Impact
On the basis of the environmental
assessment, the NRC concludes that the
proposed action will not have a
significant effect on the quality of the
human environment. Accordingly, the
NRC has determined not to prepare an
environmental impact statement for the
proposed action.
