Extension of Time Limit for Preliminary
Results
Pursuant to section 751(a)(3)(A) of
Tariff Act of 1930, as amended (the Act),
the Department shall make a
preliminary determination in an
administrative review of an
antidumping order within 245 days after
the last day of the anniversary month of
the date of publication of the order.
Section 751(a)(3)(A) of the Act further
provides, however, that the Department
may extend the 245-day period up to
365 days if it determines it is not
practicable to complete the review
within the foregoing time period. We
determine that it is not practicable to
complete this administrative review
within the time limits mandated by
section 751(a)(3)(A) of the Act due to
the complexity of the issues involved
and the need to solicit more information
from USIMINAS, regarding its
affiliations and certain components of
its claimed expenses and their
calculation. Therefore, we have fully
extended the deadline for completing
the preliminary results by 120 days, to
not later than March 31, 2010, in
accordance with section 751(a)(3)(A) of
the Act. The deadline for the final
results of the review continues to be 120
days after the publication of the
preliminary results.
This extension notice is published in
accordance with sections 751(a)(3)(A)
and 777(i) of the Act.

Background
On July 9, 2009, the Department of
Commerce (‘‘Department’’) published in
the Federal Register the preliminary
results of the 2007–2008 administrative
review of the antidumping duty order
on silicon metal from the People’s
Republic of China (‘‘PRC’’), covering the
period June 1, 2007, through May 31,
2008. See Silicon Metal from the

(July 9, 2009). On October 29, 2009, the
Department published a notice
extending the deadline for the final
results of the 2007–2008 administrative
review of silicon metal from the PRC.

results are currently due no later than
December 7, 2009.
Extension of Time Limit for the Final
Results
Section 751(a)(3)(A) of the Tariff Act
of 1930, as amended (‘‘Act’’), requires
that the Department issue the final
results of an administrative review
within 120 days after the date on which
the preliminary results are published. If
it is not practicable to complete the
review within that time period, section
751(a)(3)(A) of the Act allows the
Department to extend the deadline for
the final results to a maximum of 180
days after the date on which the
preliminary results are published. On
October 29, 2009, the Department
extended the deadline of the final
results by 31 days. Thus, the
Department may extend the deadline of
the final results by an additional 29
days.
The Department requires additional
time to properly consider the issues
raised by interested parties regarding
the treatment of Export Tax, Value–
Added Tax, surrogate values for factors
of production, and numerous company–
specific issues. Thus, it is not
practicable to complete this review by
December 7, 2009. Therefore, the
Department is extending the time limit

Saccharin From the People’s Republic
of China: Preliminary Results of
Changed Circumstances Review
AGENCY: Import Administration,

SUMMARY: On July 23, 2009, the
Department of Commerce (‘‘the
Department’’) published in the Federal
Register a notice of initiation of changed
circumstances review for saccharin from
the People’s Republic of China (‘‘PRC’’)
in response to a request on behalf of
PMC Specialties Group, Inc.
(‘‘PMCSG’’).1 The Department has
preliminarily determined that there is
insufficient evidence of changed
circumstances to warrant revocation of
this order.
