149th Meeting of the Advisory Council
on Employee Welfare and Pension
Benefit Plans
Notice of Meeting
Pursuant to the authority contained in
Section 512 of the Employee Retirement
Income Security Act of 1974 (ERISA), 29
U.S.C. 1142, the 149th open meeting of
the Advisory Council on Employee
Welfare and Pension Benefit Plans will
be held on November 3–4, 2009.
The meeting will take place in Room
S–4215, U.S. Department of Labor, 200
Constitution Avenue, NW., Washington,
DC 20210 on November 3, from 1 p.m.
to approximately 5 p.m. On November
4, the meeting will start at 9 a.m. and
conclude at approximately 4:30 p.m.,
with a break for lunch. The morning
meeting on November 4 also will be in
Room S–4215. The afternoon session
will take place in Room S–2508 at the
same address. The purpose of the open
meeting is for the Advisory Council
members to finalize their
recommendations to be presented by the
Advisory Council to the Secretary. At
the November 4 afternoon session, the
Council members will receive an update
from the Assistant Secretary of Labor for
the Employee Benefits Security
Administration (EBSA) and present
their recommendations.
The Council recommendations will be
on the following issues: (1) Promoting
Retirement Literacy and Security by
Streamlining Disclosures to Participants
and Beneficiaries, (2) Stable Value
Funds and Retirement Security in the
Current Economic Conditions, and (3)
Approaches for Retirement Security in
the United States. Descriptions of these
topics are available on the Advisory
Council page of the EBSA Web site at

Organizations or members of the
public wishing to submit a written
statement may do so by submitting 30
copies on or before October 27, 2009 to

Statements also may be submitted as email attachments in text or pdf format

Carolina.
Principal Product/Purpose: The loan,
guarantee, or grant application is to
enable an existing screen printing and
point-of-sale (POS) advertising business
to open a new branch or facility. The

SUPPLEMENTARY INFORMATION: Section
188 of the Consolidated Farm and Rural
Development Act of 1972, as established
under 29 CFR Part 75, authorizes the
United States Department of Agriculture
to make or guarantee loans or grants to
finance industrial and business
activities in rural areas. The Secretary of
Labor must review the application for
financial assistance for the purpose of
certifying to the Secretary of Agriculture
that the assistance is not calculated, or
likely, to result in: (a) A transfer of any
employment or business activity from
one area to another by the loan
applicant’s business operation; or, (b)
An increase in the production of goods,
materials, services, or facilities in an
area where there is not sufficient
demand to employ the efficient capacity
of existing competitive enterprises
unless the financial assistance will not
have an adverse impact on existing
competitive enterprises in the area. The
Employment and Training
Administration within the Department
of Labor is responsible for the review
and certification process. Comments
should address the two bases for
certification and, if possible, provide
data to assist in the analysis of these
issues.
