Agency Information Collection Activities; Proposed Collection; Comment Request; Notice of Supplemental Distribution of a Registered Pesticide Product; EPA ICR No. 0278.10, OMB Control No. 2070-0044
In compliance with the Paperwork Reduction Act (PRA) (44 U.S.C. 3501 et seq.), this document announces that EPA is planning to submit a request to renew an existing approved Information Collection Request (ICR) to the Office of Management and Budget (OMB). This ICR, entitled: ``Notice of Supplemental Distribution of a Registered Pesticide Product'' and identified by EPA ICR No. 0278.10 and OMB Control No. 2070-0044, is scheduled to expire on March 31, 2010. Before submitting the ICR to OMB for review and approval, EPA is soliciting comments on specific aspects of the proposed information collection.
Starch, oxidized, polymers with Bu acrylate, tert-Bu acrylate and styrene; Tolerance Exemption
This regulation establishes an exemption from the requirement of a tolerance for residues of starch, oxidized, polymers with Bu acrylate, tert-Bu acrylate and styrene, minimum number average molecular weight (in amu) 10,000, (CAS Reg. No. 204142-80-3) when used as an inert ingredient in a pesticide chemical formulation under 40 CFR 180.960. Kemira Chemicals, Inc., submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of starch, oxidized, polymers with Bu acrylate, tert-Bu acrylate and styrene, on food or feed commodities.
Notice of New Fee Site; Federal Lands Recreation Enhancement Act, (Title VIII, Pub. L. 108-447)
The Sequoia National Forest is proposing to charge a $175, $200, and $250 per night fee for the overnight rental of three cabins located on newly acquired National Forest System lands known as Upper Grouse Valley in the Giant Sequoia National Monument. These three cabins have not been available for public recreation use prior to this date. Rentals of other cabins on the Sequoia National Forest have shown that people appreciate and enjoy the availability of rental cabins. Funds from these rentals will be used for the continued operation and maintenance of the cabins and improvements. If there are excess funds, they will be used to improve the quality of the experience for visitors to the Giant Sequoia Monument. Improvements considered would include the development of interpretive opportunities, trails, and conservation programs focusing on bringing underrepresented youth to the Monument.
2-Propenoic acid, butyl ester, polymer with ethyl 2-propenoate and N-(hydroxymethyl)-2-propenamide; Tolerance Exemption
This regulation establishes an exemption from the requirement of a tolerance for residues of 2-propenoic acid, butyl ester, polymer with ethyl 2-propenoate and N-(hydroxymethyl)-2-propenamide (CAS Reg. No. 33438-19-6) when used as an inert ingredient in a pesticide chemical formulation. Rohm and Haas Chemicals LLC, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 2-propenoic acid, butyl ester, polymer with ethyl 2- propenoate and N-(hydroxymethyl)-2-propenamide on food or feed commodities.
Data Requirements for Antimicrobial Pesticides; Technical Amendment
EPA is issuing this technical amendment to clarify that the data requirements for pesticide registration in 40 CFR part 161 are applicable only to antimicrobial pesticides.

This regulation eliminates the need to establish a maximum permissible level for residues of Oxirane, 2-methyl-, polymer with oxirane on food or feed commodities.
Industrial Economics, Incorporated; Transfer of Data
This notice announces that pesticide related information submitted to EPA's Office of Pesticide Programs (OPP) pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Federal Food, Drug, and Cosmetic Act (FFDCA), including information that may have been claimed as Confidential Business Information (CBI) by the submitter, will be transferred to Industrial Economics, Incorporated in accordance with 40 CFR 2.307(h)(3) and 2.308(i)(2). Industrial Economics, Incorporated has been awarded multiple contracts to perform work for OPP, and access to this information will enable Industrial Economics, Incorporated to fulfill the obligations of the contract.

This regulation establishes an exemption from the requirement of a tolerance for residues of 2-butenedioic acid (2Z)-, monobutyl ester, polymer with methoxyethene, sodium salt, minimum number average molecular weight of (in amu) 18,200 (CAS Reg. No. 205193-99-3) when used as an inert ingredient in a pesticide chemical formulation under 40 CFR 180.960. Steptoe & Johnson, LLP, on behalf of, International Specialty Products submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 2-Butenedioic acid (2Z)-, monobutyl ester, polymer with methoxyethene, sodium salt, on food or feed commodities.
Registration Review; Boll Weevil Attractants Opened for Review and Comment
EPA has established a registration review docket for Boll Weevil Attractants which is listed in the table in Unit III.A. With this document, EPA is opening the public comment period for this registration review. Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. Registration review dockets contain information that will assist the public in understanding the types of information and issues that the Agency may consider during the course of registration reviews. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment
Glyphosate; Pesticide Tolerances
This regulation increases the tolerance for residues of glyphosate in or on cotton, gin byproducts. Cheminova, Inc requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
Acetochlor; Pesticide Tolerances
This regulation modifies tolerances for residues of acetochlor and its metabolites in or on the commodities corn, field, forage; corn, field, stover; and corn, pop, stover. The modifications are detailed in Unit II. of this document. Monsanto Company requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
Federal Motor Vehicle Theft Prevention Standard; Final Listing of 2010 Light Duty Truck Lines Subject to the Requirements of This Standard and Exempted Vehicle Lines for Model Year 2010
This final rule announces NHTSA's determination that there are no new model year (MY) 2010 light duty truck lines subject to the parts-marking requirements of the Federal motor vehicle theft prevention standard because they have been determined by the agency to be high-theft or because they have a majority of interchangeable parts with those of a passenger motor vehicle line. This final rule also identifies those vehicle lines that have been granted an exemption from the parts-marking requirements because the vehicles are equipped with antitheft devices determined to meet certain statutory criteria.
American Recovery and Reinvestment Act: 504 Loan Program Debt Refinancing
This interim final rule implements section 504 of the American Recovery and Reinvestment Act of 2009 (Recovery Act), which authorizes projects approved for financing under Title V of the Small Business Investment Act to include a limited amount of debt refinancing if the project involves the expansion of a small business concern and meets certain other conditions. This interim final rule makes the existing 504 Loan Program rules consistent with section 504 of the Recovery Act.

Public Meeting of the President's Council on Bioethics; Cancellation
A notice was published in the Federal Register on Friday, May 29, 2009, Vol. 74, No. 102, to announce that a meeting of the President's Council on Bioethics was scheduled to be held on Thursday, June 25, 2009, and Friday, June 26, 2009. This meeting has been cancelled in its entirety. Currently, there are no plans to reschedule this meeting.
Relocation of 2 GHz Broadcast Auxiliary Service
In this document the Commission waives the deadline by which Sprint Nextel must complete relocation of the broadcast auxiliary service (BAS) to frequencies above 2025 MHz until February 8, 2010. The Commission also eliminates the requirement that MSS entrants to the 2000-2020 MHz band may not begin operations until the BAS incumbents in the top 30 markets by population and all fixed BAS links in the 1990- 2025 MHz band have been relocated. MSS entrants will be allowed to conduct operations in markets where the BAS incumbents have not been relocated only if they successfully coordinate with the BAS incumbents. In addition, the Commission waives the requirement that New ICO Satellite Services G.P. must first make available to the public commercial satellite service throughout its satellite's coverage area before it may commercially operate Ancillary Terrestrial Service (ATC) in conjunction with it satellite system.

Public Water Supply Supervision Program; Program Revision for the State of Idaho
Notice is hereby given that the State of Idaho has revised its approved State Public Water Supply Supervision Primacy Program. Idaho has adopted regulations analogous to EPA's Variance and Exemptions Rule, Stage 2 Disinfectants and Disinfection Byproducts Rule, Long Term 2 Enhanced Surface Water Treatment Rule, Ground Water Rule, and Lead and Copper Short-Term Regulatory Revisions and Clarifications Rule. EPA has determined that these revisions are no less stringent than the corresponding federal regulations. Therefore, EPA intends to approve these State program revisions. By approving these rules, EPA does not intend to affect the rights of Federally recognized Indian tribes within ``Indian country'' as defined by 18 U.S.C. 1151, nor does it intend to limit existing rights of the State of Idaho.

Jointly Owned Invention Available for Non-Exclusive, Royalty-Free Licensing for Advanced Encryption Standard S-box Applications
The invention listed below is jointly owned by the U.S. Government, as represented by the Department of Commerce, and the University of Southern Denmark. The Department of Commerce's interest in the invention is available for non-exclusive, royalty-free licensing in the Field of Use of Advanced Encryption Standard S-box applications, in accordance with 35 U.S.C. 207 and 37 CFR part 404 to achieve expeditious commercialization of results of federally funded research and development.

Magnuson-Stevens Act Provisions; General Provisions for Domestic Fisheries; Application for Exempted Fishing Permit
The Assistant Regional Administrator for Sustainable Fisheries, Northeast Region, NMFS, has made a preliminary determination that the subject exempted fishing permit (EFP) application contains all the required information and warrants further consideration. Therefore, NMFS announces that the Assistant Regional Administrator proposes to recommend that an EFP be issued that would allow four commercial fishing vessel to conduct fishing operations that are otherwise restricted by the regulations governing the fisheries of the Northeastern United States. The EFP, which would enable the applicants to land more than one standard tote of female red crabs and to conduct at-sea sampling and tagging, would allow for exemptions for up to four vessels from the Atlantic Deep-sea Red Crab Fishery Management Plan (FMP).
