Administration (MARAD), is authorized
to grant waivers of the U.S.-build
requirement of the coastwise laws under
certain circumstances. A request for
such a waiver has been received by
MARAD. The vessel, and a brief
description of the proposed service, is
listed below. The complete application
is given in DOT docket MARAD–2008–
0115 at https://www.regulations.gov.
Interested parties may comment on the
effect this action may have on U.S.
vessel builders or businesses in the U.S.
that use U.S.-flag vessels. If MARAD
determines, in accordance with 46
U.S.C. 12121 and MARAD’s regulations
at 46 CFR part 388 (68 FR 23084; April
30, 2003), that the issuance of the
waiver will have an unduly adverse
effect on a U.S.-vessel builder or a
business that uses U.S.-flag vessels in
that business, a waiver will not be
granted. Comments should refer to the
docket number of this notice and the
vessel name in order for MARAD to
properly consider the comments.
Comments should also state the
commenter’s interest in the waiver
application, and address the waiver
criteria given in § 388.4 of MARAD’s
regulations at 46 CFR Part 388.

Notice of Exemption.
SUMMARY: The Board grants an
exemption, under 49 U.S.C. 10502, from
the prior approval requirements of 49
U.S.C. 11323–25 for Genesee &
Wyoming Inc. (GWI), a noncarrier, to
acquire control of Summit View, Inc.
(Summit View), and thereby to acquire
control of the 10 Class III railroads
controlled by Summit View, pursuant to
a Stock Purchase Agreement entered
into by and between GWI and Jerry Joe
Jacobson, owner of all Summit View
shares. The transaction will be subject
to the labor protection required by 49
U.S.C. 11326(b).
DATES: This exemption will be effective
on January 29, 2009. Petitions to stay
must be filed by January 12, 2009.
Petitions to reopen must be filed by
January 21, 2009.

SUMMARY: The Surface Transportation
Board will hold a public hearing
beginning at 10 a.m. on Wednesday,
February 11, 2009, at its headquarters in

public hearing will be allow interested
persons to comment on the Board’s new
responsibilities in the recently passed
Passenger Rail Investment and
Improvement Act of 2008 (Pub. L. 110–
432), and thereby assist the Board in
effectively implementing these
important new provisions of law.
DATES: The public hearing will take
place on Wednesday, February 11, 2009.
Any person wishing to speak at the
hearing should file with the Board a
written notice of intent to participate,
and should identify the party, the
proposed speaker, and the time
requested, as soon as possible but no
later than January 28, 2009. Each
speaker should also file with the Board
his/her written testimony in that same
document. Written submissions by
interested persons who do not wish to
appear at the hearing will also be due
by January 28, 2009.

SUPPLEMENTARY INFORMATION: On
October 16, 2008, the Passenger Rail
Investment and Improvement Act of
2008 became law. The Act enhances the
Board’s role with regard to the National
Railroad Passenger Corporation
(Amtrak) and commuter rail operators.
The Board is holding this public hearing
to allow interested persons to comment
on the Board’s new responsibilities and
to advise the Board on how to
effectively implement them. While
interested persons may comment on any
aspect of the Act as it pertains to the
Board, the Board is particularly
interested in the following areas.
Section 207 instructs the Federal
Railroad Administration and Amtrak, in
consultation with the Board and others,
to establish standards and metrics to
measure the performance and service
quality of intercity passenger trains.
