Investigations Regarding Certifications
of Eligibility To Apply for Worker
Adjustment Assistance and Alternative
Trade Adjustment Assistance
Petitions have been filed with the
Secretary of Labor under Section 221(a)
of the Trade Act of 1974 (‘‘the Act’’) and
are identified in the Appendix to this
notice. Upon receipt of these petitions,
the Director of the Division of Trade
Adjustment Assistance, Employment
and Training Administration, has
instituted investigations pursuant to
Section 221(a) of the Act.
The purpose of each of the
investigations is to determine whether
the workers are eligible to apply for
adjustment assistance under Title II,
Chapter 2, of the Act. The investigations
will further relate, as appropriate, to the
determination of the date on which total
or partial separations began or
threatened to begin and the subdivision
of the firm involved.
The petitioners or any other persons
showing a substantial interest in the
subject matter of the investigations may
request a public hearing, provided such
request is filed in writing with the
Director, Division of Trade Adjustment
Assistance, at the address shown below,
not later than December 26, 2008.
Interested persons are invited to
submit written comments regarding the

administrative reconsideration of the
Department’s negative determination
regarding eligibility to apply for Trade
Adjustment Assistance (TAA) and
Alternative Trade Adjustment
Assistance (ATAA), applicable to

subject firm. The denial notice was
signed on October 21, 2008 and
published in the Federal Register on
November 10, 2008 (73 FR 66677).
Pursuant to 29 CFR 90.18(c)
reconsideration may be granted under
the following circumstances:
(1) If it appears on the basis of facts
not previously considered that the
determination complained of was
erroneous;
(2) If it appears that the determination
complained of was based on a mistake
in the determination of facts not
previously considered; or
(3) If in the opinion of the Certifying
Officer, a misinterpretation of facts or of
the law justified reconsideration of the
decision.
The initial investigation resulted in a
negative determination was based on
the finding that imports of beer did not
contribute importantly to worker

separations at the subject facility and
there was no shift of production to a
foreign country. The subject firm did
not import beer during the relevant
period. The ‘‘contributed importantly’’
test is generally demonstrated through a
survey of the workers’ firm’s declining
domestic customers. A survey
conducted by the Department of Labor
revealed that a major customer did not
purchase imported beer in 2006, 2007
and during January through August
2008.
The petitioner provided a citation
from the 2007 shareholder report that
‘‘competitiveness with foreign product
on the shelves of distributors has
increased’’ and stated that the workers
of the subject firm should be eligible for
TAA because domestic production has
been ‘‘disrupted’’ by foreign products.
The investigation revealed no imports
of beer during the relevant period and
