subparagraph does not require the
release of information protected by law
from public disclosure.’’
The Agency publishes a profile on
each individual that submits an
application in order to provide the
public with the information required by
TEA 21. The Federal diabetes
exemption application informs the
applicant, in detail, of all information
that will be published in the Federal
Register related to their application.
Therefore, each applicant is fully
informed of this requirement prior to
submitting their application.
AGENCY:

docket and based upon its evaluation of
the fifty-five exemption applications,

from the ITDM standard in 49 CFR
391.41(b)(3), subject to the conditions
listed under ‘‘Conditions and
Requirements’’ above.
In accordance with 49 U.S.C. 31136(e)
and 31315 each exemption will be valid
for two years unless revoked earlier by
FMCSA. The exemption will be revoked
if: (1) The person fails to comply with

person may apply to FMCSA for a

that time.
SUMMARY: As authorized by Public Law
105–383 and Public Law 107–295, the
Secretary of Transportation, as
represented by the Maritime
Administration (MARAD), is authorized
to grant waivers of the U.S.-build
requirement of the coastwise laws under
certain circumstances. A request for
such a waiver has been received by
MARAD. The vessel, and a brief
description of the proposed service, is
listed below. The complete application
is given in DOT docket MARAD–2007–
28000 at https://dms.dot.gov. Interested
parties may comment on the effect this
action may have on U.S. vessel builders
or businesses in the U.S. that use U.S.flag vessels. If MARAD determines, in
accordance with Public Law 105–383
and MARAD’s regulations at 46 CFR
part 388 (68 FR 23084; April 30, 2003),
that the issuance of the waiver will have
an unduly adverse effect on a U.S.vessel builder or a business that uses
U.S.-flag vessels in that business, a
waiver will not be granted. Comments
should refer to the docket number of
this notice and the vessel name in order
for MARAD to properly consider the
comments. Comments should also state
the commenter’s interest in the waiver
application, and address the waiver
criteria given in § 388.4 of MARAD’s
regulations at 46 CFR part 388.
DATES: Submit comments on or before
May 30, 2007.
