Secretary of Labor under Section 221(a)
of the Trade Act of 1974 (‘‘the Act’’) and
are identified in the Appendix to this
notice. Upon receipt of these petitions,
the Director of the Division of Trade
Adjustment Assistance, Employment
and Training Administration, has
instituted investigations pursuant to
Section 221(a) of the Act.
The purpose of each of the
investigations is to determine whether
the workers are eligible to apply for
adjustment assistance under Title II,
Chapter 2, of the Act. The investigations
will further relate, as appropriate, to the
determination of the date on which total
or partial separations began or
threatened to begin and the subdivision
of the firm involved.
The petitioners or any other persons
showing a substantial interest in the
subject matter of the investigations may
request a public hearing, provided such
request is filed in writing with the
Director, Division of Trade Adjustment
Assistance, at the address shown below,
not later than October 6, 2006.

Department of Labor issued a
Certification of Eligibility to Apply for
Worker Adjustment Assistance and
Alternative Trade Adjustment
Assistance on August 25, 2006,
applicable to workers of Eaton
Corporation, Torque Control Products
Division, Marshall, Michigan. The
notice was published in the Federal
Register on September 13, 2006 (71 FR
54095).
At the request of the State agency, the
Department reviewed the certification
for workers of the subject firm. The
workers are engaged in the production
of automotive differential gears and are
not separately identifiable by product
line.

New findings show that there was a
previous certification, TA–W–54,067,
issued on February 17, 2004, covering
the identical worker group as the subject
firm, who were engaged in employment
related to the production of automotive
differential gears. That certification
expired on February 17, 2006. To avoid
an overlap in worker group coverage,
the certification is being amended to
change the impact date from August 14,
2005 to February 18, 2006, for workers
of the subject firm.
The amended notice applicable to
TA–W–59,900 is hereby issued as
follows:
All workers of Eaton Corporation, Torque
Control Products Division, Marshall,
Michigan, who became totally or partially
separated from employment on or after
February 18, 2006, through August 25, 2008,
are eligible to apply for adjustment assistance
under section 223 of the Trade Act of 1974
and are also eligible to apply for alternative
trade adjustment assistance under Section
246 of the Trade Act of 1974.

In accordance with Section 223 of the
Trade Act of 1974, as amended (19
U.S.C. 2273) the Department of Labor
herein presents summaries of
determinations regarding eligibility to
apply for trade adjustment assistance for
workers (TA–W) number and alternative
trade adjustment assistance (ATAA) by
(TA–W) number issued during the
period of September 11 through
September 15, 2006.
In order for an affirmative
determination to be made for workers of
a primary firm and a certification issued
regarding eligibility to apply for worker
adjustment assistance, each of the group
eligibility requirements of Section
222(a) of the Act must be met.
I. Section (a)(2)(A) all of the following
must be satisfied:
A. A significant number or proportion
of the workers in such workers’ firm, or
an appropriate subdivision of the firm,
have become totally or partially
separated, or are threatened to become
totally or partially separated;
B. The sales or production, or both, of
such firm or subdivision have decreased
