application for administrative
reconsideration was filed with the
Director of the Division of Trade
Adjustment Assistance for workers at
U.S. Airways, Inc., Greentree
Reservations, Pittsburgh, Pennsylvania.
The application did not contain new
information supporting a conclusion
that the determination was erroneous,
and also did not provide a justification
for reconsideration of the determination
that was based on either mistaken facts
or a misinterpretation of facts or of the
law. Therefore, dismissal of the
application was issued.

Pursuant to Section 221 of the Trade
Act of 1974, an investigation was
initiated on November 23, 2005 in
response to a petition filed on behalf of
workers at Weston Foods, Ltd., West
Hazelton, Pennsylvania (TA–W–58,404).
The petitioner has requested that the
petition be withdrawn. Consequently,
further investigation in this case would
serve no purpose, and the investigation
has been terminated.

In accordance with Section 223 of the
Trade Act of 1974 (19 U.S.C. 2273) the
Department of Labor issued a
Certification of Eligibility to Apply for
Worker Adjustment Assistance on July
20, 2005, applicable to workers of
Wyeth, Wyeth Pharmaceuticals, Health
Care Division, Rouses Point, New York.
The notice was published in the Federal
Register on August 26, 2005 (70 FR
50412). The workers are engaged in the
production of over the counter
medicine.
New information provided by the
petitioners show their intention was to
apply for all available Trade Act
benefits at the time of the filing.
Therefore, the Department has made a
decision to investigate further to
determine if the workers are eligible to
apply for Alternative Trade Adjustment
Assistance.
Information obtained from the
company states that a significant
number of workers of the subject firm
are age 50 or over, workers have skills
that are not easily transferable, and
conditions in the industry are adverse.
Review of this information shows that
all eligibility criteria under Section 246
of the Trade Act of 1974 (26 U.S.C.
2813), as amended have been met for
workers at the subject firm.
Accordingly, the Department is
amending the certification to reflect its
finding.
The amended notice applicable to
TA–W–57,987 is hereby issued as
follows:
All workers of Wyeth, Wyeth
Pharmaceuticals Division, Health Care
Division, Rouses Point, New York, who
became totally or partially separated from
employment on or after June 3, 2004 through
July 20, 2007, are eligible to apply for
adjustment assistance under Section 223 of
the Trade Act of 1974 and are also eligible
to apply for Alternative Trade Adjustment
Assistance under Section 246 of the Trade
Act of 1974.

Notice.
SUMMARY: The Department of Labor, as
part of its continuing effort to reduce
paperwork and respondent burden,
conducts a preclearance consultation
program to provide the general public
and Federal agencies with an
opportunity to comment on proposed
and/or continuing collections of
information in accordance with the
Paperwork Reduction Act of 1995
(PRA95) [44 U.S.C. 3506(c)(A)]. This
program helps to ensure that requested
data can be provided in the desired
format, reporting burden (time and
financial resources) is minimized,
collection instruments are clearly
understood, and the impact of collection
requirements on respondents can be
properly assessed. Currently, the
Employment and Training
Administration (ETA), Office of
Workforce Security, is soliciting
comments concerning the proposed
modification of the case investigation
procedures for the BAM data collection.
