Negative Determinations for Alternative Trade Adjustment Assistance In order for the Division of Trade Adjustment Assistance to issued a certification of eligibility to apply for Alternative Trade Adjustment Assistance (ATAA) for older workers, the group eligibility requirements of section 246(a)(3)(A)(ii) of the Trade Act must be met. In the following cases, it has been determined that the requirements of section 246(a)(3)(ii) have not been met for the reasons specified. Upon receipt of these petitions, the Director of the Division of Trade Adjustment Assistance, Employment and Training Administration, has instituted investigations pursuant to Section 221(a) of the Act. The purpose of each of the investigations is to determine whether the workers are eligible to apply for adjustment assistance under Title II, Chapter 2, of the Act. The investigations will further relate, as appropriate, to the determination of the date on which total or partial separations began or threatened to begin and the subdivision of the firm involved. The notice was published in the Federal Register on April 1, 2005 (70 FR 16848). At the request of the State agency, the Department reviewed the certification for workers of the subject firm. The workers are engaged in the production of wood products, including shapes, knobs, and gallery rail spindles; workers are not separately identifiable by specific products. New information provided by the state shows that in October, 2005, American Pride purchased the Guilford, Maine facility of Pride Manufacturing Company LLC and is currently known as American Pride. The State agency also reports that workers wages at the subject firm are being reported under the Unemployment Insurance (UI) tax account for American Pride, Guilford, Maine. Accordingly, the Department is amending the certification to properly reflect this matter.
