DC 20555, and include a statement of
good cause for the extension. Any
request for a hearing shall be submitted
to the Secretary, U.S. Nuclear
Regulatory Commission, ATTN: Chief,
Rulemakings and Adjudications Staff,
Washington, DC 20555. Copies also
shall be sent to the Director, Office of
Enforcement, U.S. Nuclear Regulatory

Materials Litigation and Enforcement at
the same address, to the Regional

Ryan Plaza Drive, Suite 400, Arlington,
Texas 76011, and to the Licensee.
Because of continuing disruptions in
delivery of mail to United States
Government offices, it is requested that
answers and requests for hearing be
transmitted to the Secretary of the
Commission either by means of
facsimile transmission to 301–415–1101
or by e-mail to hearingdocket@nrc.gov
and also to the Office of the General
Counsel either by means of facsimile
transmission to 301–415–3725 or by email to OGCMailCenter@nrc.gov. If a
person other than the licensee requests
a hearing, that person shall set forth
with particularity the manner in which
his interest is adversely affected by this
Confirmatory Order and propose at least
one admissible contention, addressing
the criteria set forth in 10 CFR 2.309(d)
and (f).
If a hearing is requested by a person
whose interest is adversely affected, the
Commission will issue an Order
designating the time and place of any
hearing. If a hearing is held, the issue to
be considered at such hearing shall be
whether this Confirmatory Order should
be sustained. In the absence of any
request for hearing, or written approval
of an extension of time in which to
request a hearing, the provisions
specified in section IV above shall be
final 20 days from the date of this
Confirmatory Order without further
order or proceedings. If an extension of
time for requesting a hearing has been
approved, the provisions specified in
Section IV shall be final when the
extension expires if a hearing request
has not been received. An Answer or a
Request for Hearing Shall Not Stay the
Immediate Effectiveness of this Order.

Sunshine Act, Pub. L. 94–409, that the
Securities and Exchange Commission
will hold the following meeting during
the week of December 5, 2005:
A closed meeting will be held on
Thursday, December 8, 2005 at 2 p.m.
Commissioners, Counsel to the
Commissioners, the Secretary to the
Commission, and recording secretaries
will attend the closed meeting. Certain
staff members who have an interest in
the matters may also be present.
The General Counsel of the
Commission, or his designee, has
certified that, in his opinion, one or
more of the exemptions set forth in 5
U.S.C. 552b(c), (3), (5), (7), (9)(B), and
(10) and 17 CFR 200.402(a), (3), (5), (7),
9(ii) and (10) permit consideration of
the scheduled matters at the closed
meeting.
Commissioner Glassman, as duty
officer, voted to consider the items
listed for the closed meeting in closed
session.
The subject matter of the closed
meeting scheduled for Thursday,
December 8, 2005 will be:
Formal orders of investigations;
Institution and settlement of injunctive
actions;
Institution and settlement of
administrative proceedings of an
enforcement nature; and an
Adjudicatory matter.
At times, changes in Commission
priorities require alterations in the
scheduling of meeting items.

Pursuant to Section 19(b)(1) of the
Securities Exchange Act of 1934
(‘‘Act’’),1 and Rule 19b–4 thereunder,2
notice is hereby given that on
September 1, 2005, the Chicago Board
Options Exchange, Incorporated
(‘‘CBOE’’ or ‘‘Exchange’’) filed with the
Securities and Exchange Commission
(‘‘Commission’’) the proposed rule
change as described in Items I, II, and
III below, which Items have been
prepared by the CBOE. On November 8,
2005, the Exchange filed Amendment
No. 1 to the proposal.3 The Exchange
filed the proposed rule change, as
amended, as a ‘‘non-controversial’’ rule
change under Rule 19b–4(f)(6) under the
Act,4 which renders the proposal
effective upon filing with the
Commission. The Commission is
publishing this notice to solicit
comments on the proposed rule change,
as amended, from interested persons.
I. Self-Regulatory Organization’s
Statement of the Terms of Substance of
the Proposed Rule Change
The CBOE proposes to delete certain
rules, or portions thereof, which have
been determined by the Exchange to be
obsolete or unnecessary. The text of the
proposed rule change is available on
Exchange’s Web site (https://
www.cboe.com), at the CBOE’s Office of
the Secretary, and at the Commission’s
Public Reference Room.

Change
In its filing with the Commission, the
CBOE included statements concerning
the purpose of and basis for the
proposed rule change and discussed any
