105–383 and Public Law 107–295, the

Secretary of Transportation, as
represented by the Maritime
Administration (MARAD), is authorized
to grant waivers of the U.S.-build
requirement of the coastwise laws under
certain circumstances. A request for
such a waiver has been received by
MARAD. The vessel, and a brief
description of the proposed service, is
listed below. The complete application
is given in DOT docket 2005–22651 at
https://dms.dot.gov. Interested parties
may comment on the effect this action
may have on U.S. vessel builders or
businesses in the U.S. that use U.S.-flag
vessels. If MARAD determines, in
accordance with Public Law 105–383
and MARAD’s regulations at 46 CFR
part 388 (68 FR 23084; April 30, 2003),
that the issuance of the waiver will have
an unduly adverse effect on a U.S.vessel builder or a business that uses
U.S.-flag vessels in that business, a
waiver will not be granted. Comments
should refer to the docket number of
this notice and the vessel name in order
for MARAD to properly consider the
comments. Comments should also state
the commenter’s interest in the waiver
application, and address the waiver
criteria given in § 388.4 of MARAD’s
regulations at 46 CFR part 388.

Eaton Aeroquip, Inc., Grant of Petition
for Decision of Inconsequential
Noncompliance
Eaton Aeroquip, Inc. (Eaton) has
determined that the end fittings that it
produced for nylon air brake hoses do
not comply with S7.2.2(d) of 49 CFR
571.106, Federal Motor Vehicle Safety
Standard (FMVSS) No. 106, ‘‘Brake
hoses.’’ Pursuant to 49 U.S.C. 30118(d)
and 30120(h), Eaton has petitioned for
a determination that this
noncompliance is inconsequential to
motor vehicle safety and has filed an
appropriate report pursuant to 49 CFR
part 573, ‘‘Defect and Noncompliance
Reports.’’ Notice of receipt of a petition
was published, with a 30-day comment
period, on August 25, 2005, in the
Federal Register (70 FR 49972). NHTSA
received no comments.
Affected are a total of approximately
7,784,614 end fittings produced from
2001 to June 30, 2005, plus an
indeterminate number of end fittings
produced prior to 2001 for which
records are not available (Eaton
acquired the end fitting manufacturing
business on November 1, 2002).
S7.2.2(d) of FMVSS No. 106 requires
that each fitting shall be etched,
embossed, or stamped with
(d) The * * * outside diameter of the
plastic tubing to which the fitting is properly
attached expressed in inches or fractions of
inches or in millimeters followed by the
letters OD * * *.
The subject end fittings are missing
the letters OD from their labels.
Eaton believes that the
noncompliance is inconsequential to
motor vehicle safety and that no
corrective action is warranted. Eaton
states that the purpose of the letters OD
on the label is to indicate that the
measurement refers to the outside
