Written Submissions: The
Commission does not plan to hold a
public hearing in connection with the
preparation of this report. However,
interested persons are invited to submit
written statements concerning the
matters to be addressed in the report.
All written submissions should be
addressed to the Secretary, United
States International Trade Commission,
500 E Street SW., Washington, DC
20436. To be assured of consideration
by the Commission, written statements
relating to the Commission’s report
should be submitted to the Commission
at the earliest practical date and should
be received no later than the close of
business on November 30, 2005. All
written submissions must conform with
the provisions of section 201.8 of the
Commission’s Rules of Practice and
Procedure (19 CFR 201.8). Section 201.8
of the rules requires that a signed
original (or a copy designated as an
original) and fourteen (14) copies of
each document be filed. In the event
that confidential treatment of the
document is requested, at least four (4)
additional copies must be filed, in
which the confidential business
information (CBI) must be deleted (see
the following paragraph for further
information regarding CBI). The
Commission’s rules do not authorize
filing submissions with the Secretary by
facsimile or electronic means, except to
the extent permitted by section 201.8 of
the rules (see Handbook for Electronic
Filing Procedures, ftp://ftp.usitc.gov/
pub/reports/
electronic_filing_handbook.pdf).
Persons with questions regarding
electronic filing should contact the

Any submissions that contain CBI
must also conform with the
requirements of section 201.6 of the
Commission’s rules (19 CFR 201.6).
Section 201.6 of the rules requires that
the cover of the document and the
individual pages clearly be marked as to
whether they are the ‘‘confidential’’ or
‘‘nonconfidential’’ version, and that the
CBI be clearly identified by means of
brackets. All written submissions,
except for CBI, will be made available
for inspection by interested parties.
The Commission may include any CBI
received in the confidential report it
sends to the USTR. Should the
Commission at a later date make its
report available to the public, any CBI
received by the Commission in this
investigation will not be published in
that report in a manner that would
reveal the operations of the firm
supplying the information.

SUPPLEMENTARY INFORMATION:
Background
In October 2003, the Commission
determined, by a two-to-two vote, that
an industry in the United States was

materially injured by reason of subject
imports of hard red spring wheat from
Canada. On June 7, 2005, a binational
panel formed under Article 1904 of the
NAFTA issued a decision in its review
of the Commission’s determination. The
panel remanded the determination to
the Commission with an order to take
further action consistent with its
instructions. The Commission is
directed to issue its remand
determination within 90 days of the
issuance of the Panel’s decision, i.e., by
September 6, 2005.
Reopening the Record
In order to assist it in making its
determination on remand, the
Commission is reopening the record in
this investigation to seek additional
information with respect to certain of
the instructions provided by the panel.
Participation in the Remand
Proceedings
Only those interested parties who
were parties to the original
investigations (i.e., persons listed on the
Commission Secretary’s service list)
may participate in this remand
proceeding. No additional filings with
the Commission will be necessary for
these parties to participate in the
remand proceeding. Business
proprietary information (BPI) obtained
during the remand proceeding will be
governed, as appropriate, by the
administrative protective order (APO)
issued in the original investigations.
(Parties who participated in the original
investigation, if no longer covered by
the APO, are directed to contact the
Commission Secretary.)
Written Submissions
Information obtained during the
remand investigation will be released to
the parties under the administrative
protective order (‘‘APO’’) issued in the
original investigations on or about July
19, 2005. The remand staff report will
be placed in the nonpublic record on
August 1, 2005, and a public version
will be issued thereafter, pursuant to
section 207.22 of the Commission’s
rules. Parties that are participating in
the remand proceedings may file
comments on or before August 8, 2005
with respect to how the record, as
supplemented, bears on the issues
presented by the panel’s remand
instructions.
No additional factual information may
be included in such comments.
Comments shall not exceed 30 pages of
textual material, double-spaced and
single-sided, on stationery measuring
81⁄2 x 11 inches.
