NRS 430A.010 Definitions. As used in this chapter, unless the context otherwiserequires, the words and terms defined in NRS430A.015 to 430A.080, inclusive,have the meanings ascribed to them in those sections.

NRS 430A.015 Actionplan defined. Action plan means a plan establishedby a family resource center, with input from the family resource center council,which describes the services to be offered by the family resource center in anat-risk community.

NRS 430A.020 At-riskcommunity defined. At-risk community meansa geographic area that the Director has declared to be in need of social andeconomic assistance and social service programs because of the number offamilies who reside there who:

1. Have low incomes;

2. Are transient; or

3. Have members whose ability to excel in academics,work and social situations is impaired by the educational, economic and socialsituation of the family as a unit.

NRS 430A.030 Directordefined. Director means the Director of theDepartment of Health and Human Services.

NRS 430A.040 Familyresource center defined. Family resource centermeans a facility within an at-risk community where families may obtain:

1. An assessment of their eligibility for socialservices;

2. Social services; and

3. Referrals to obtain social services from othersocial service agencies or organizations.

NRS 430A.045 Familyresource center council defined. Family resourcecenter council means an organization of people who reside in an at-riskcommunity who assist and advise the family resource center which serves theircommunity.

NRS 430A.070 Neighborhoodcouncil defined. [Replaced in revision by NRS 430A.045.]

 

NRS 430A.080 Socialservice agency defined. Social serviceagency means any public agency or organization of this state that providessocial services for families, including, without limitation, services relatingto employment, child care, health care, drug abuse, education or welfare.

NRS 430A.090 Directorof Department of Human Resources to appoint local governing board; Director toidentify at-risk neighborhoods; duties of local governing boards. Repealed.(See chapter 137, Statutesof Nevada 2005, at page 475.)

 

NRS 430A.100 Solicitationand acceptance of gifts and grants by Director; accounting; grants of money tofamily resource centers; duties of Grants Management Advisory Committeeconcerning allocation of money.

1. The Director may solicit and accept gifts andgrants of money and other property, including real property, from any public orprivate source and may use the property and expend the money, subject to anylimitations contained in the gift or grant, to carry out the provisions of thischapter.

2. Money received by the Director pursuant to thissection must be accounted for separately in the State General Fund. The moneyin the account does not revert to the State General Fund at the end of anyfiscal year and must be carried forward to the next fiscal year.

3. The Director may make grants of money from theaccount to family resource centers to pay for any expenses incurred by thosecenters in carrying out their responsibilities, and may place such conditionson the acceptance of those grants as he determines are necessary, includingrequiring a center to provide matching money.

4. The Advisory Committee shall review all requestsfor grants of money to family resource centers and shall make recommendationsto the Director concerning the allocation of money in the account.

5. As used in this section, Advisory Committee meansthe Grants Management Advisory Committee created by NRS 232.383 or a working group of theGrants Management Advisory Committee that is appointed pursuant to NRS 232.387.

NRS 430A.110 Powerof Director to enter into contracts. TheDirector may enter into a contract with any person, association, government,governmental agency or political subdivision of a government to assist him incarrying out the provisions of this chapter.

NRS 430A.120 Directorto adopt regulations. The Director shall adoptsuch regulations as are necessary to carry out the provisions of this chapter.The regulations must provide:

1. Criteria for evaluating and determining thegeographic boundaries for at-risk communities.

2. A method for establishing family resource centers,which must include the option of designating existing organizations as familyresource centers.

3. Criteria for evaluating and approving action plans.The criteria must provide that no action plan will be approved unless it is:

(a) Tailored to meet the specific needs of thecommunity;

(b) Developed with input from members of the familyresource center council; and

(c) Feasible in relation to the resources available tothe family resource center to which the action plan applies.

4. Criteria for the establishment and composition of afamily resource center council.

NRS 430A.130 Solicitationand acceptance of gifts and grants by family resource centers and familyresource center councils. Each family resourcecenter and family resource center council may solicit and accept gifts andgrants of money and other property, including real property, from any public orprivate source and may use the property and expend the money, subject to anylimitations contained in the gift or grant, to carry out its functions.

NRS 430A.140 Familyresource center to submit action plan to Director for approval.

1. Before a family resource center may obtain a grantfrom the Director, the family resource center:

(a) Must submit to the Director an action plan createdby the family resource center with input from the family resource centercouncil; and

(b) Must obtain approval from the Director of thataction plan.

2. An action plan must be resubmitted to the Directorfor his approval:

(a) On or before July 1 of each year; and

(b) Any time the family resource center adopts a proposedamendment to the action plan.

NRS 430A.150 Familyresource center councils: Establishment required; meetings to comply with OpenMeeting Law.

1. Each family resource center shall establish afamily resource center council. The composition of the family resource centercouncil must be consistent with the criteria set forth by regulations adoptedpursuant to NRS 430A.120.

2. All meetings of a family resource center councilmust be conducted in accordance with the provisions of chapter 241 of NRS.

NRS 430A.160 Servicesprovided.

1. Each family resource center shall provide referralsto obtain, if available, the following services:

(a) Education on caring for infants and day careservices for infants;

(b) Education on parenting;

(c) Health care services for children, including allrequired immunizations;

(d) Programs to identify and assist developmentallydisabled infants and young children of up to 5 years of age;

(e) Day care for children who are old enough to attendschool, both before and after school;

(f) Programs to assist senior citizens;

(g) Programs to supplement formal education, including,without limitation, mentor programs for pupils in elementary and secondaryschools, literacy programs, programs that encourage parental involvement inschool, programs that teach English as a second language, programs to assist inthe naturalization process and other alternative educational programs;

(h) Programs to teach adults and children skills foremployment and self-sufficiency;

(i) Services that will assist families with physicaland mental health issues, the special needs of children, food and nutritionalneeds, recreational needs, housing problems, domestic violence and substanceabuse;

(j) Programs designed to reduce the rate of pregnanciesin unmarried teenage girls;

(k) Programs designed to reduce the rate at whichpupils drop out of school;

(l) Transportation services, particularly to assistpeople in traveling to the social service agencies from which they may bereceiving services pursuant to this section;

(m) Classes that teach alternative means of resolvingdisputes that arise in the family; and

(n) Any other services for which the communities thatthe family resource center serves have a need.

2. Each family resource center may offer servicesdirectly through its own employees and resources or contract with socialservice agencies to provide services, or may do both.

3. Any family resource center that offers servicesdirectly through its own employees and resources shall comply with allapplicable state and federal laws and regulations regarding the delivery of theservices.

NRS 430A.170 Casemanagers; training; plans developed with families.

1. Each family resource center must have a casemanager and may have a coordinator to handle administrative matters. If afamily resource center does not employ a separate person to act as coordinator,the case manager shall also act as coordinator.

2. The Director shall provide training for all casemanagers on how to assess the needs of families using the family resourcecenter.

3. The case manager shall, for each family that seeksservices from the center, develop a plan with the family which specifies:

(a) The services for which the family is eligible;

(b) Whether the family will receive services from thefamily resource center or a social service agency, or both;

(c) The responsibilities the family members mustfulfill to remain eligible for the services; and

(d) The manner in which the performance ofresponsibilities by the agency and the family members will be monitored.

NRS 430A.180 Prohibitedservices and procedures. When providing serviceson behalf of a family resource center which has received a grant from the Directorpursuant to the provisions of this chapter, an employee or volunteer at thefamily resource center shall not administer drugs or contraceptives to orperform medical or dental procedures for a minor unless written consent toadminister those drugs or contraceptives or to perform those procedures hasbeen obtained from the minors parent, guardian or legal custodian.

NRS 430A.190 Privilegedcommunications. Except as otherwise providedby a specific statute, any communications made to or documents received by an employeeor volunteer at a family resource center from a person to obtain the servicesof the center are privileged and may not be disclosed without the personsconsent or unless so ordered by a court of competent jurisdiction.

NRS 430A.200 Reportsby family resource centers; reports by Director.

1. On or before August 1 of each year, each familyresource center shall submit a report to the Director summarizing itsachievements and accounting for the expenditure of any money provided to it bythe Director for the previous fiscal year.

2. On or before September 30 of each year, theDirector shall provide a written report to the Interim Finance Committeeconcerning the expenditure during the preceding fiscal year of all moneyreceived by the Director for carrying out the provisions of this chapter.

NRS 430A.210 Socialservice agencies to cooperate with family resource centers. All social service agencies shall cooperate with familyresource centers in carrying out the provisions of this chapter, to the extentthat doing so does not conflict with federal law or a specific state statute oradministrative regulation.
