UNITED STATES SENATORS

NRS 304.010 Nominationand election. At the primary and generalelection next preceding the expiration of the time for which any United StatesSenator was elected or appointed to represent the State of Nevada in the UnitedStates Senate, candidates for United States Senator may be nominated andelected in the same manner as provided by law for the nomination and electionof state officers.

NRS 304.030 Governorto appoint qualified person upon vacancy in office. Incase of a vacancy in the office of United States Senator caused by death,resignation or otherwise, the Governor may appoint some qualified person tofill the vacancy, who shall hold office until the next general election anduntil his successor shall be elected and seated.

REPRESENTATIVES

Nomination and Election

NRS 304.040 Nominationof candidates; exception. Except as otherwiseprovided in NRS 304.200 to 304.250, inclusive, party candidates forRepresentative in Congress shall be nominated in the same manner as stateofficers are nominated.

NRS 304.050 Election.

1. At the general election in each even-numbered year,there shall be elected the number of Representatives in the Congress of theUnited States to which the State of Nevada is entitled.

2. Representatives in Congress shall be elected by theregistered voters of their respective districts.

Districts

NRS 304.060 Definitions. As used in NRS 304.060to 304.120, inclusive, unless thecontext otherwise requires:

1. Block means the smallest geographical unit whoseboundaries were designated by the Bureau of the Census of the United StatesDepartment of Commerce in its topographically integrated geographic encodingand referencing system.

2. Block group means a combination of blocks whosenumbers begin with the same digit.

3. Census tract means a combination of block groups.

4. Census voting district means the voting district:

(a) Based on the geographic and population databasescompiled by the Bureau of the Census of the United States Department ofCommerce as validated and incorporated into the geographic information systemby the Legislative Counsel Bureau for use by the Nevada Legislature; and

(b) Designated in the maps filed with the Office of theSecretary of State pursuant to subsection 3 of NRS 304.070.

NRS 304.070 Copiesof maps of congressional districts: Duties of Director of Legislative CounselBureau. The Director of the LegislativeCounsel Bureau shall:

1. Retain in an office of the Legislative CounselBureau, copies of maps of the congressional districts described in NRS 304.100, 304.110 and 304.120.

2. Make available copies of the maps to any interestedperson for a reasonable fee, not to exceed the actual costs of producing copiesof the maps.

3. File a copy of the maps with the Secretary ofState.

NRS 304.080 Copiesof maps of congressional districts: Duties of Secretary of State. The Secretary of State shall:

1. Provide to the clerk of each county and the clerkof Carson City, copies of the maps filed pursuant to subsection 3 of NRS 304.070.

2. Make available copies of the maps to any interestedperson for a reasonable fee, not to exceed the actual costs of producing copiesof the maps.

NRS 304.090 Omittedarea: Attachment to appropriate congressional district.

1. If any area of this State is omitted from theprovisions of NRS 304.060 to 304.120, inclusive, inadvertently or byvirtue of the complexities of the information supplied to the Legislature, thecounty clerk, the Carson City clerk or the Director of the Legislative CounselBureau, upon discovery of the omission, shall notify the Secretary of State ofthe omission. The Secretary of State shall attach that area to the appropriatecongressional district as follows:

(a) If the area is surrounded by a congressionaldistrict, the area must be attached to that district.

(b) If the area is contiguous to two or morecongressional districts, the area must be attached to the district that has theleast population.

2. Any attachments made pursuant to the provisions ofthis section must be certified in writing and filed with the Director of theLegislative Counsel Bureau and with the Secretary of State. No change may bemade in any attachments until the districts are again reapportioned.

Special Election to Fill Vacancy

NRS 304.200 Definitions. As used in NRS 304.200to 304.250, inclusive, unless thecontext otherwise requires, the words and terms defined in NRS 304.210 and 304.220 have the meanings ascribed to themin those sections.

NRS 304.210 Catastrophedefined. Catastrophe means a natural orman-made event that causes, by death or disappearance, a vacancy in at leastone-fourth of the total number of offices in the United States House ofRepresentatives, including any number of offices representing the State ofNevada, or at least one-half of the total number of offices representing theState of Nevada.

NRS 304.220 Disappearancedefined. Disappearance means the inabilityto establish conclusively whether a Representative in Congress has survived acatastrophe.

NRS 304.230 Governorto issue election proclamation; when election is to be conducted; consolidationwith other elections.

1. In the event of a vacancy in the office ofRepresentative in Congress, the Governor shall, within 7 days after the eventgiving rise to the vacancy, issue an election proclamation calling for aspecial election to fill the vacancy. The Governor shall specify the date ofthe special election in the proclamation. Except as otherwise provided insubsection 2, the election must be conducted:

(a) As soon as practicable after the issuance of theproclamation;

(b) On a Tuesday; and

(c) Not more than 180 days after the issuance of theproclamation. If the vacancy is caused by a catastrophe, the election must beconducted not more than 90 days after the issuance of the proclamation.

2. A special election required pursuant to subsection1 may be consolidated with a statewide election or local election scheduled tobe conducted within 90 days after the issuance of the proclamation. The specialelection may be consolidated with a local election occurring wholly orpartially within the same territory in which the vacancy exists only if thevoters eligible to vote in the local election comprise at least 50 percent ofall voters eligible to vote on the vacancy.

NRS 304.240 Issuanceby Governor of election proclamation precludes holding of primary election;nomination of candidates; placement of names of candidates on ballot; conductof election; application of general election laws; exception.

1. If the Governor issues an election proclamationcalling for a special election pursuant to NRS304.230, no primary election may be held. Except as otherwise provided inthis subsection, a candidate must be nominated in the manner provided in chapter 293 of NRS and must file a declaration oracceptance of candidacy within the time prescribed by the Secretary of Statepursuant to NRS 293.204, which must beestablished to allow a sufficient amount of time for the mailing of electionballots. A candidate of a major political party is nominated by filing adeclaration or acceptance of candidacy within the time prescribed by theSecretary of State pursuant to NRS 293.204.A minor political party that wishes to place its candidates on the ballot mustfile a list of its candidates with the Secretary of State not more than 46 daysbefore the special election and not less than 32 days before the specialelection. To have his name appear on the ballot, an independent candidate mustfile his petition of candidacy with the appropriate filing officer not morethan 46 days before the special election and not less than 32 days before thespecial election.

2. Except as otherwise provided in NRS 304.200 to 304.250, inclusive:

(a) The election must be conducted pursuant to theprovisions of chapter 293 of NRS.

(b) The general election laws of this State apply tothe election.

NRS 304.250 Regulations. The Secretary of State shall adopt such regulations as arenecessary for conducting elections pursuant to the provisions of NRS 304.200 to 304.250, inclusive.
