Churchill County

NRS 243.015 Organizedas distinct county1864. Churchill County,with its western boundary fixed on the line of longitude 4140west, as established by DeGroots map of Nevada Territory, published in 1863,and with its other boundaries as established by law, is organized into adistinct county, with all the rights, privileges and immunities thereuntobelonging.

NRS 243.020 Boundaryline between Churchill and Lander Counties1869. Theeast line of the County of Churchill, and the west line of the County ofLander, being the dividing line between the Counties, shall be established anddefined in this section as: Commencing at a point where a line drawn due northand south through the Mount Airy Station would strike the south line of theCounty of Humboldt, if extended; thence in a southwesterly direction to thedividing ridge or center of Cones Passa pass so-calledin a range ofmountains extending south of and including New Pass Station, called the NewPass Mountains; thence in a southerly course along the center of the range ofmountains to a point on the north line of Esmeralda County, immediately northof the Town of Ellsworth; the line to be so fixed and established along andover the course before mentioned as to place on the westerly side thereof, andwhich shall be included in the County of Churchill, all lands which shed orflow their waters into or toward the Edwards Creek Valley, and on the easterlyside thereof, and which shall be included in the County of Lander, all landswhich shed or flow their waters into or toward the Smith or Smiths Creek Valley,or the Reese River Valley.

NRS 243.030 Countyseat at Fallon. After the first Monday inJanuary 1904, the county seat of Churchill County shall be located at the Cityof Fallon in Churchill County.

Clark County

NRS 243.035 Creation1909. Except as otherwise provided in NRS 243.293, the County of Clark is herebyerected out of the following territory: All that portion of Lincoln Countylying south of the 3rd standard parallel south of Mount Diablo baseline ishereby detached from Lincoln County and the County of Clark erected therefrom.

Douglas County

NRS 243.045 Creation1861;northern boundary redefined 1965; boundary line between Lyon and DouglasCounties redefined 1967.

1. There shall be a county, to be known as DouglasCounty, to include all that part of the State of Nevada within the boundariesdescribed as follows: Beginning at Masons Ranch on the Walker River andrunning westerly in a straight line to the mouth of Clear Creek; thence alongthe middle of Clear Creek to its source; thence due west to the Californialine; thence south and southeasterly along the line to the western boundary ofLyon County; thence northerly along the boundary to the place of beginning.

2. Notwithstanding anything to the contrary insubsection 1, the north boundary line of Douglas County is redefined on March2, 1965, and such north boundary line is particularly described as follows:Beginning at Masons Ranch on the Walker River and running westerly in astraight line toward the mouth of Clear Creek to a point where such lineintersects the centerline of Eldorado Canyon in section 18, T. 14 N., R. 22 E.;thence northeasterly down the centerline of Eldorado Canyon, a distance of 500feet, more or less, to its intersection with a point on the north boundary ofsuch section 18 which is also common to a point on the south boundary ofsection 7, T. 14 N., R. 22 E., the southeast corner of the new south boundaryof Carson City and from which point the southeast corner of such section 7bears S. 8951 E. a distance of 1,386 feet; thencewesterly along the new south boundary of Carson City to the Nevada-Californiastate line. All township and range references are to the Mount Diablo Base andMeridian.

3. NRS 243.055 Creation1869. All that portion of the present County of Lander lyingwithin the following boundaries: East of a line drawn north and south through apoint on the Central Pacific Railroad track, 3 miles west of the machine shopof the Central Pacific Railroad Company, situated in the Town of Carlin, andnorth of a line drawn east and west through the most northerly part or portionof the military post or camp known as Camp Ruby (being the northerly line ofthe proposed County of White Pine), is hereby created a new county, to be knownas the County of Elko.

NRS 243.300 Portionof Esmeralda County detached and attached to Nye County; boundary line betweenNye and Esmeralda Counties1913.

1. The boundary line between Nye County and EsmeraldaCounty shall be determined by a joint survey as provided in this section. TheCounty of Nye shall appoint a competent surveyor, who shall act with acompetent surveyor to be appointed by the County of Esmeralda. The twosurveyors so appointed shall appoint a third competent surveyor. The appointingpower herein provided shall be vested in the Boards of County Commissioners ofthe two Counties, where the Counties are vested with the appointing power. Thethree surveyors appointed as herein provided shall constitute a board ofsurveyors, who shall jointly run and determine the actual boundary line betweenthe Counties, according to NRS 243.290,beginning at the Nevada-California line and running thence northerly andnorthwesterly to the Hot Springs mentioned in NRS243.290. The survey shall be in accordance with the practice of the UnitedStates Surveyor Generals office in running township lines and establishingmonuments thereon.

2. The expense of the survey provided for in thissection shall be divided equally between Esmeralda and Nye Counties. The surveyshall be completed on or before January 1, 1914, and blueprints of maps and acopy of the field notes of the survey shall be filed with the county clerk ofeach county and with the Surveyor General of Nevada and with the United StatesSurveyor General for Nevada.

3. The board of surveyors, as herein provided, are furtherdirected and required to include within the boundaries of Nye County all thosecertain sections specified in section 1 of chapter 89, Statutes of Nevada 1903,and all of such sections of land so described and specified are hereby made apart of Nye County, and the board of surveyors shall include such parcels ofland within the boundaries of Nye County in such a manner as a majority of theboard of surveyors may deem wise.

4. The surveyed boundary line as determined accordingto the provisions of this section shall be the true boundary line between theCounties of Nye and Esmeralda.

Nothing in the provisions of NRS 243.390 to 243.415, inclusive, shall be construed soas to compel or force the boards of county commissioners of the severalcounties of this state to have any county line or lines surveyed andestablished, except where such county line or lines are now, or may hereafterbe, in dispute by reason of the settlement of persons and the ownership ofproperty along such county line or lines.

PROCEDURE FOR ABOLISHMENT OF COUNTIES

NRS 243.420 Approvalof act by voters. Whenever any act of theLegislature abolishes a county in this State, such act shall not becomeeffective until approved by a majority of all the qualified voters of thecounty affected voting at a special election to be called for that purpose.

NRS 243.425 Countycommissioners to call special election. Theboard of county commissioners of the county affected shall, within 60 daysafter the approval of the act by the Governor, cause an election to be held atthe various places of voting in the county. The board of county commissionersshall give notice of the special election by publication once a week for 4weeks in some newspaper published in the county or by posting written orprinted notices at the several voting precincts in the county. The notice shallstate the time and place of holding the election and for what purpose suchelection is held.

NRS 243.430 Printingand form of ballots. The board of county commissionersshall authorize and direct the county clerk to cause to be printed a sufficientnumber of ballots for the election. The title of the act shall be set out onthe ballot and the question printed upon the ballot for the information of thevoter shall be as follows: Shall the act (setting out the title thereof) beapproved?

NRS 243.435 Conductof election. The special election shall beconducted in accordance with the provisions of the law relating to generalelections so far as the same can be made applicable.

NRS 243.440 Expensesof election. The board of county commissionersshall cause all expenses of printing, publication of notices and expenses ofholding the election to be paid out of the county general fund.

NRS 243.445 Canvassof votes; transmission of certified abstract. Theelection officers shall make returns to the board of county commissioners, whoshall, within 7 days thereafter, meet and canvass the vote. The county clerkmust make a certified abstract thereof, seal such abstract, endorse itelection returns and without delay transmit it by registered mail to theSecretary of State.

NRS 243.450 Abstractfiled; result certified to Governor. Thecertified abstract of such returns must be filed in the Office of the Secretaryof State, and, if it appears therefrom that a majority of all the qualifiedvoters voting at the election have approved the act, the Secretary of Statemust certify the result of such vote to the Governor.

NRS 243.455 Proclamationby Governor. The Governor must thereupon issuehis proclamation, stating therein the result of the vote in the countyaffected, and that the act has been approved by a majority of all the qualifiedvoters voting at the election. The act shall become effective on the date ofthe proclamation.

PROCEDURE FOR RELOCATION OF COUNTY SEATS

NRS 243.460 Relocationof county seats. County seats may be removedand new locations selected as provided in NRS243.460 to 243.490, inclusive.

NRS 243.465 Petitionfor removal of county seat: Requirements; notice; hearing. Whenever the residents of any county in this state shallfile a petition with the clerk of the board of county commissioners, signed byqualified electors of the county, who are also taxpayers of the county asappears by the last real or personal property assessment roll, equal in numberto at least 60 percent of the legal votes cast at the last preceding generalelection in the county, asking for the removal of the county seat of the countyto some other designated place, the board of county commissioners shall fix atime for a public hearing upon the petition, which time shall be within 30 daysafter the filing of the petition, and the clerk of the board of countycommissioners shall give notice thereof by publication in a newspaper publishedin the county as may be designated by the board, at least once in each week for2 weeks, the first publication to be at least 2 weeks before the date ofhearing.

NRS 243.470 Sufficiencyof petition; proposition to be submitted to voters; limitation on withdrawingnames from petition.

1. At the time specified in the notice, the board ofcounty commissioners shall meet and inquire into and determine the sufficiencyof the petition and the validity of the signatures thereto, and if sufficientand signed by the required number, the board shall make an order directing thatthe proposition to remove the county seat to the place named in the petition besubmitted to a vote of the qualified electors of the county at the next primaryor general election.

2. No names may be withdrawn from the petition afterthe petition has been filed with the clerk of the board of county commissionersexcept in cases of actual fraud in the procuring of signatures to the petition.

NRS 243.475 Orderof election: Contents; publication. The ordershall state the time and places where the proposition is to be voted upon, andthe board of county commissioners shall cause a certified copy of such order tobe published in some newspaper of general circulation published in the countyas may be designated by the board, at least once in each week for 2 weeks, thefirst publication to be at least 40 days before the date of the election.

NRS 243.480 Formand canvass of ballots; certification of returns. Theballots to be voted at the election must have printed thereon the words Forremoval of the county seat to ................ (inserting the name of theplace to which removal is proposed) and Against removal of the county seat to................ (inserting the name of the place to which removal isproposed). The ballot must be canvassed as in elections for county officers andthe returns of the election must be certified by the county clerk to theSecretary of State, together with a certified copy of the order of the board ofcounty commissioners and a sworn certificate of the publication thereof, to befiled in the Office of the Secretary of State.

NRS 243.485 Countyrecords, offices, property and prisoners to be removed to new county seat;penalty.

1. If a majority of the votes cast on the propositionof removal is in favor of removal of the county seat, so soon as convenientbuildings can be had at such new county seat the board of county commissionersshall cause all the county records, county offices and property pertainingthereto, and all county prisoners, to be removed to the new county seat.

2. Any county commissioner or other county officer whoshall neglect or refuse to carry out any of the provisions of this sectionshall be guilty of a misdemeanor.

NRS 243.490 Noticeof establishment of new county seat; actions and proceedings. When a new county seat shall have been established inaccordance with NRS 243.460 to 243.490, inclusive, the board of countycommissioners shall cause due notice thereof to be published in some newspaperof general circulation published in the county for 4 consecutive weeks, beingfour publications, and all suits, actions, process, prosecutions andproceedings already commenced or that may be commenced in the district courtfor the county shall proceed to final judgment and execution at such new countyseat.
