SBA Lender Risk Rating System
On March 1, 2010, the Small Business Administration (SBA) published a notice in the Federal Register to implement changes to the agency's Risk Rating System (Risk Rating System). The Risk Rating System is an internal tool to assist SBA in assessing the risk of each active 7(a) Lender's and Certified Development Company's (CDC's) SBA loan operations and loan portfolio. The notice provided a sixty (60) day comment period, which closes on April 30, 2010. SBA is extending this comment period an additional thirty (30) days to May 30, 2010. SBA is also correcting the notice to indicate the proper docket number to be referenced when submitting comments, and to clarify the method for calculating the gross past due rate.

Notice of Intent To Prepare an Environmental Impact Statement (EIS) for the Sale of Plum Island, NY
Pursuant to the requirements of the National Environmental Policy Act (NEPA) of 1969, and the President's Council on Environmental Quality Regulations (40 CFR 1500-1508), as implemented by the U.S. General Services Administration (GSA) Order PBS P 1095.4C, GSA, as the operational Joint Lead Agency, announces its Notice of Intent (NOI) to prepare an EIS for the anticipated sale of Plum Island, New York and an ancillary support facility at Orient Point, New York. The US Department of Homeland Security (DHS) will act as a Joint Lead Agency in ongoing consultation with GSA for the NEPA and associated regulatory compliance activities.
Eligibility for Commercial Flats Failing Deflection
The Postal Service published a proposed rule regarding eligibility for commercial flats failing deflection in the Federal Register on December 14, 2009. This final rule provides revised mailing standards and price eligibility for commercial flats of all classes that fail to meet the deflection standard.
Transitional Safe Harbor Protection for Treatment by the Federal Deposit Insurance Corporation as Conservator or Receiver of Financial Assets Transferred by an Insured Depository Institution in Connection With a Securitization or Participation
The Federal Deposit Insurance Corporation (``FDIC'') is amending its regulation, Defining Transitional Safe Harbor Protection for Treatment By The Federal Deposit Insurance Corporation As Conservator Or Receiver Of Financial Assets Transferred In Connection With A Securitization Or Participation. The amendment adds a new provision in order to continue for a limited time the safe harbor provision for securitizations that would be affected by recent changes to generally accepted accounting principles. In effect, the Final Rule permanently ``grandfathers'' all securitizations for which financial assets were transferred or, for revolving trusts, for which securities were issued prior to September 30, 2010 so long as those securitizations complied with the preexisting requirements under generally accepted accounting principles in effect prior to November 15, 2009. The transitional safe harbor will apply irrespective of whether or not the securitization satisfies all of the conditions for sale accounting treatment under generally accepted accounting principles as effective for reporting periods after November 15, 2009. In addition, the Final Rule confirms that section 360.6 will continue to protect participations.
Maximum Per Diem Rates for the Continental United States (CONUS)
On December 3, 2009, the IRS announced a $0.075 cent decrease in the Standard Mileage Rate for moving purposes from $0.24 cents to $0.165 cents per mile. This new Standard Mileage Rate for moving purposes is effective January 1, 2010, through December 31, 2010. Thus, the reimbursement rate for privately owned vehicles (POV) used in conjunction with official relocation will also be $0.165 for the same period.
New Postal Product
The Commission is noticing a recently-filed Postal Service request to include a new contract within the existing Global Expedited Package Services 2 (GEPS 2) product. FDIC Advisory Committee on Economic Inclusion (ComE-IN); Notice of Meeting
In accordance with the Federal Advisory Committee Act, notice is hereby given of a meeting of the FDIC Advisory Committee on Economic Inclusion, which will be held in Washington, DC. The Advisory Committee will provide advice and recommendations on initiatives to expand access to banking services by underserved populations.
Agency Information Collection Activities; Submission for OMB Review; Comment Request
The information collection requirements described below will be submitted to the Office of Management and Budget (``OMB'') for review, as required by the Paperwork Reduction Act (``PRA''). The FTC is seeking public comments on its proposal to extend through March 31, 2013, the current PRA clearance for information collection requirements contained in its Alternative Fuel Rule (or ``Rule''). This clearance expires on March 31, 2010.
Notice of Intent To Request Public Comments
As part of its systematic review of all Federal Trade Commission rules and guides, the Commission gives notice that, during 2010, it intends to request public comments on the rules listed below (``Rules''). The Commission will request comments on, among other things, the economic impact of and the continuing need for the Rules; possible conflict between the Rules and state, local, or other federal laws or regulations; and the effect of any technological, economic, or other industry changes on the Rules. Further, the Commission gives notice that, based on its current ongoing review proceedings, it is postponing regulatory review for certain rules previously scheduled for 2010 review. In addition, the Commission announces that it is accelerating its review of the Labeling Requirements for Alternative Fuels and Alternative Fueled Vehicles Rule to 2010. No Commission determination on the need for, or the substance of, the Rules should be inferred from the notice of intent to publish requests for comments. Finally, the Commission announces a revised 10-year regulatory review schedule.

In accordance with the Federal Advisory Committee Act, as amended (5 U.S.C. Appendix 2), the National Archives and Records Administration (NARA) announces a meeting of the Advisory Committee on the Electronic Records Archives (ACERA). The committee serves as a deliberative body to advise the Archivist of the United States, on technical, mission, and service issues related to the Electronic Records Archives (ERA). This includes, but is not limited to, advising and making recommendations to the Archivist on issues related to the development, implementation and use of the ERA system. This meeting will be open to the public. However, due to space limitations and access procedures, the name and telephone number of individuals planning to attend must be submitted to the Electronic Records Archives Program at era.program@nara.gov. In accordance with requirements of the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.), the FDIC may not conduct or sponsor, and the respondent is not required to respond to, an information collection unless it displays a currently valid Office of Management and Budget (OMB) control number. The FDIC hereby gives notice that it is seeking public comment on the proposed renewal of the following collections: Application for Consent to Reduce or Retire Capital (OMB No. 3064-0079); Appraisal Standards (OMB No. 3064-0103); Activities and Investments of Savings Associations (OMB No. 3064-0104), Forms Relating to Outside Counsel, Legal Support & Expert Services (OMB No. 3064- 0122); and Prepaid Assessments (OMB No. 3064-0173). Exclusive Service Contracts for Provision of Video Services in Multiple Dwelling Units and Other Real Estate Developments
This document is the Commission's Second Report and Order concerning video services in multiple dwelling units (``MDUs''), which are apartment and condominium buildings and centrally managed residential real estate developments. The Second Report and Order resolves some issues the Commission left undecided in its First Report and Order, concerning two practices called ``bulk billing'' and ``marketing exclusivity.'' The Second Report and Order concludes that bulk billing and marketing exclusivity, at present, create more benefits than harms for MDU residents. The Commission therefore allows both practices to continue.
