Section 3-9 - Extent of Review

The Board's review shall be confined to the record as supplemented pursuant to Section 8 of this chapter, oral argument, and such briefs as may be filed. The Board's review shall be limited to a determination of whether the county board action is:
(a) Arbitrary, capricious, an abuse of discretion or otherwise not in accordance with law;
(b) In excess of statutory jurisdiction, authority or limitations or lacking statutory right;
(c) Without observance of procedure required by law; or
(d) Unsupported by substantial evidence.
