Section 7-8 - Special Education Funding

(a) School district or pubic [public] agency eligibility. School district or public agency Part B funding shall be implemented in accordance with 34 C.F.R. §§ 300.200 through 300.230 and any other applicable provisions.,

(b) Compliance with applicable laws and regulations. Each school district or public agency shall adopt and implement appropriate policies, procedures, programs and services to ensure that children with disabilities who reside within the agency's educational jurisdiction, including children who are enrolled in private schools or facilities such as residential treatment centers, day treatment centers, hospitals, mental health institutions are identified and evaluated, and have access to FARE in compliance with all applicable requirements of Wyoming laws and any applicable federal laws and regulations.

(c) Condition of assistance. A school district or public agency is eligible for federal funding under Part B of the IDEA for a fiscal year if the school district or public agency submits a plan that provides assurances to the WDE that the school district or public agency meets each of the conditions set forth in this section and these rules.
