(a) Noncompetitive negotiations (sometimes also known as "sole sourcing") may proceed when the Commission has:
(i) Obtained an approved waiver under Section
5 of this chapter; and
(ii) Secured
a bid from a qualified bidder that meets the solicitation response requirements
of Section 8.
