Section 2-21 - Reimbursement for state licensed shelter care services

(a) Per diem rate. The per diem payment for state licensed shelter care services shall be equal to the nursing facility's Medicaid per diem rate, minus the recipient's contribution.
(b) Recipient contribution. The recipients contribution to the cost of state licensed shelter care services shall be the recipient's income minus:
(i) The personal needs allowance permitted by
Medicaid;
(ii) The spousal
allowance permitted by Medicaid;
(iii) The dependent allowance permitted by
Medicaid;
(iv) Medical and/or
health insurance premiums; and
(iii) Other medical expenses which the
recipient incurs and pays, including co-payments and
deductibles.
(c) Recipients of state licensed shelter care services are not Medicaid recipients for purposes of cost reporting pursuant to Chapter VII or any other services under the Medicaid program.
