Section 2-18 - Mandatory establishment of trusts

(a) Mandatory establishment of trusts. A recipient who is not eligible for Medicaid, but who could become eligible for Medicaid through the establishment of a trust pursuant to Chapter 2.7, must establish such a trust by the end of the fourth month after the last day of the month in which the individual becomes eligible for state licensed shelter care services, except individuals that are eligible for State Licensed Shelter Care Services pursuant to paragraph 15(a)(vi).

(b) The failure to comply with this Section shall result in the termination of state licensed shelter care services, unless termination would result in an undue hardship.

(c) Once an individual becomes eligible for Medicaid, the designation of nursing facility requirements of subsection 15(b) shall no longer apply.
