Chapter 13 - EARLY INTERVENTION AND DEVELOPMENTAL PRESCHOOL STATE FUNDING
Section 13-4 - General Provisions

(a) The Division shall determine the number of infants, toddlers, and preschool children age birth through five (5) years of age with developmental disabilities in their regions who are eligible for developmental preschool services.

(b) The number shall include all children who are currently receiving developmental preschool services, and children who have been determined to be eligible by the following criteria:

(i) There is a consent for evaluation signed and dated by parents; and

(ii) Program staff have met with parents and parents anticipate they will provide consent for services; and

(iii) Results of at least one (1) assessment indicates the child has a disability; or

(iv) Qualified personnel have used informed clinical opinion to establish child's disability; or

(v) The child has a diagnosed physical or medical condition that has a high probability of resulting in a developmental delay and who by reason thereof needs early intervention services.

(c) Service providers shall calculate the number of children age birth through five (5) years of age who are eligible for developmental preschool services on November 1 or the first business day thereafter. Service providers shall submit the calculation to the Division within three (3) business days of the count. These numbers shall be used to calculate payments to service providers for the subsequent fiscal year.

(d) The Division shall multiply the total number of children age birth through five (5) years of age who are eligible for developmental preschool services on November 1 of the year in which the budget request is being prepared by the specified per child amount. This total amount shall be used in the preparation of the budget request.
