Section 2-19 - Transfer of Permits

(a) Permits may be transferred by a permittee to a new owner or operator if:
(i) Conditional transfers. The permit has
been modified or revoked and reissued to identify the new permittee and to
incorporate such other requirements as may be necessary under these
regulations.
(ii) Automatic
transfers. A permit may be automatically transferred to a new permittee if:
(A) The current permittee notifies the
director in writing at least 30 days in advance of the proposed transfer date
in paragraph (b) (ii) of this Section;
(B) The notice includes a written agreement
between the existing and new permittees on a form provided by the
administrator. The form shall contain a specific date for transfer of permit
responsibility, coverage and liability between the two parties; and
(C) The director does not notify the existing
permittee and the proposed new permittee of its intent to modify or revoke and
reissue the permit.
