Section 2-21 - Performance and Risk-Based Inspection

(a) Within the parameters specified under chapter 2, section 20, the regulatory authority shall prioritize and conduct more frequent inspections based upon its assessment of a public swimming pool, spa or similar installations relative risk to public health and safety and the history of compliance with these Regulations by evaluating:
(i) Past performance, for nonconformance with
these Regulations;
(ii) Past
performance, for numerous or repeat violations of these Regulations;
(iii) Past performance, for complaints
investigated and found to be valid;
(iv) The health or safety hazards associated
with the particular public swimming pool, spa or similar
installation;
(v) The type of
operation; and
(vi) The number of
people served.
