Section PC 5.10 - Determinations of parties for purposes of judicial review

The hearing examiner or the commission shall prepare a list of persons who are considered parties by the hearing examiner or the commission for purposes of judicial review as required by s. 227.47, Stats. The list shall be found at the end of every final decision issued by the commission and shall be based upon the following criteria:

(1) The nature of the case;

(2) The persons affected by the decision and the degree of that impact;

(3) The nature of the participation by those involved in the case, including attendance at hearings, cross-examination of witnesses, and submission of briefs.

The list of parties is not necessarily coextensive with the definition of "party" found in s. PC 1.02(13).
