Notwithstanding the provisions of s. NR 446.03, after December 1, 2008, no person may commence construction, or commence a modification with respect to mercury, of a coal-fired EGU unless the department finds that a 90% mercury emission reduction as measured from the mercury content of fuel combusted will be achieved.
