Section NR 328.34 - Pre-existing structures

A streambank erosion control structure authorized by department permit prior to August 1, 2007, shall continue to be authorized, provided the structure is maintained in compliance with all the conditions of the original permit. Any modifications to the structure that do not comply with the original permit conditions shall require a new permit and shall comply with all standards in this section. Bank erosion control structures that were not authorized prior to August 1, 2007, require authorization prior to any repair, modification or replacement.
