The department shall waive water quality certification requirements for projects authorized under ss. NR 300.04 and 300.05. The department shall also waive water quality certification requirements for projects that do not impact waters of the state. The department may waive water quality certification requirements for other projects on a case-by-case basis in alignment with ch. NR 299.
