Chapter NR 185 - Solid Waste Management Planning Criteria
Section NR 185.09 - Exemptions

An entity may request exemption from any of the requirements of this chapter by submitting an adequate written request and justification. In reviewing exemption requests, the department may take into account such factors as population, size of the area being served, types, amounts, and sources of solid waste, and other significant factors presented and documented by the entity. Exemption requests shall be reviewed with particular regard to any potential nuisance, hazard to public health and safety, or potential degradation of the environment. Any exemptions granted shall be in writing by the department, stating the reasons therefor.
