Section NR 135.18 - Reclamation permit application

(1) APPLICATION REQUIRED.
(a) The operator of any nonmetallic
mine shall apply for and obtain a reclamation permit before beginning mining
operations.
(b) The operator shall
submit all of the following when making an application in accordance with this
subsection:
1. The information required by
sub. (2).
2. The first year's
annual fee, as required by s.
NR 135.39.
3.
A reclamation plan conforming to s.
NR 135.19.
4.
A certification that the operator will provide, as a condition of the
reclamation permit, financial assurance as required by s.
NR 135.40
upon granting of the reclamation permit and before mining begins.
(c) To avoid duplication, the
permit application and submittals required by par. (b) may, by reference,
incorporate existing plans or materials that meet the requirements of this
chapter.
(2) APPLICATION CONTENTS. All applications for reclamation permits under this chapter shall include all of the following:
(a) A brief
description of the general location and nature of the nonmetallic
mine.
(b) A legal description of
the property on which the nonmetallic mine is located or proposed, including
the parcel identification number.
(c) The names, addresses and telephone
numbers of all persons or organizations who are owners or lessors of the
property on which the nonmetallic mining site is located.
(d) The name, address and telephone number of
the person or organization who is the operator.
(e) A certification by the operator of his or
her intent to comply with the statewide nonmetallic mining reclamation
standards established by subch. II.
