(1) PURPOSES. This chapter governs the
treatment of nonpublic personal health information and nonpublic personal
financial information about individuals by all licensees of the office of the
commissioner of insurance except to the extent that a licensee is excepted from
a provision of this chapter. This chapter does all of the following:
(a) It requires a licensee to provide notice
to individuals about its privacy policies and practices.
(b) It describes the conditions under which a
licensee may disclose nonpublic personal health information and nonpublic
personal financial information about individuals to affiliates and
nonaffiliated third parties.
(c) It
provides methods for individuals to prevent a licensee from disclosing that
information.
(2)
COMPLIANCE. This chapter applies to:
(a)
Nonpublic personal financial information about individuals who obtain or are
beneficiaries of products or services primarily for personal, family or
household purposes from licensees, about individuals who are beneficiaries
under group health plans and claimants under workers' compensation policies,
and about individuals who are third-party claimants against products or
services obtained for business, commercial or agricultural purposes. This
chapter does not apply to information about companies or about individuals who
obtain products or services for business, commercial or agricultural purposes;
and
(b) All nonpublic personal
health information about individuals who obtain or are beneficiaries of
products or services primarily for personal, family or household purposes from
licensees, about individuals who are beneficiaries under group health plans and
claimants under workers' compensation policies, and about individuals who are
third-party claimants against products or services obtained for business,
commercial or agricultural purposes, except to the extent the information is
subject to s.
51.30,

EXTRA-TERRITORIAL APPLICATION. A licensee domiciled in this state that is in
compliance with this chapter in a state that has not enacted laws or
regulations that meet the requirements of Title V of the Gramm-Leach-Bliley Act
(PL
102-106) is in compliance with Title V of the
Gramm-Leach-Bliley Act in such other state.
