Subpart 12-201 - Certification Requirement
Section 12-201.11 - General

(A) Food protection manager certification is required for:
(1) An individual who operates a
retail FOOD ESTABLISHMENT or at least one MANAGER of a retail FOOD
ESTABLISHMENT, shall have a certificate that states that the individual or
MANAGER has passed an exam from an ACCREDITED PROGRAM on FOOD protection
practices as required in s.
97.33,
Stats. And 2-102.12; provided, however, that:
(a) A NEW retail FOOD ESTABLISHMENT or a
retail FOOD ESTABLISHMENT undergoing a change of OPERATOR shall have a
certified FOOD protection MANAGER within 90 days of the initial day of
operation.
(b) A retail FOOD
ESTABLISHMENT that is not in compliance because of EMPLOYEE turnover or other
loss of a CERTIFIED FOOD protection MANAGER, shall have 90 days from the date
of the loss of a CERTIFIED FOOD protection MANAGER to comply with this
chapter.
(2) An
individual who conducts, maintains, manages, or operates a school lunchroom
that is in a school that is participating in the national school lunch program
under
42 USC
1751 to
1769j
for which food service is directly provided by the school unless the operator
or manager of the lunchroom, or his or her designee, is a certificate holder.
For purposes of this subsection, the "operator or manager of the lunchroom" is
the individual responsible for the administration of food services for a
private school, charter school established under s.
118.40(2r),
or school district. A private school, charter school established under s.
118.40(2r),
or school district complies with the requirements of this subsection if the
school or school district has one certificate holder. The individual designated
to be the CERTIFIED FOOD MANAGER will become certified within the time
specified in this subparagraph.
(B) A retail FOOD ESTABLISHMENT shall post a certificate issued under 12-201.11 (A) in a conspicuous place on the PREMISES of the retail FOOD ESTABLISHMENT.
