A marketing agreement may include only those provisions enumerated under s. 96.04(2), Stats. A marketing agreement may not include any provision which is authorized solely for marketing orders under s. 96.03(2), Stats. Marketing agreement fees collected by the department under s. 96.04(2) (f), Stats., and s. ATCP 140.33 may be used only to compensate the department for costs incurred by the department in the administration and enforcement of the marketing agreement. Fees may not be used for any other purpose.
