§64-104-5. Denial, Suspension, or Revocation of Approval.

The OEMS may deny, suspend, or revoke approval of a training program for failure to meet die requirements of W. Va. Code §§ 16-46-1 et seq., as applicable, or die provisions of diis rule series. If die OEMS determines to deny, suspend, or revoke approval of a training program, die OEMS will send die applicant a notice identifying die reasons for die determination. The notice will be sent by either registered or certified mail. The denial, suspension, or revocation will become final 30 days after the mailing of die notice unless die applicant, widiin diat 30-day period, gives written notice of a request for a hearing. Hearings will be conducted in accordance widi die Administrative Procedure Act (W.Va. Code §§ 29A-5-1 etseq), and die Bureau for Public Healdi rule series, Rules of Procedure for Contested Case Hearings and Declaratory Rulings (64 CSR 1).
