17.1. A professional, initial, or eligible certificate may be granted to a non-citizen of the United States who holds a valid Permanent Resident Card, Employment Authorization Document (EAD), or work permit issued by the United States Citizenship and Immigration Services (USCIS).
17.2. Permit for Non-United States Citizen.
17.2.a. General
Criteria. In accordance with W. Va. Code §
18A-3-2a, Exchange/Visiting
teachers who are non-United States citizen and who participate in a program or
exchange recognized and/or approved by the WVDE may be issued the Non-United
States Citizen Permit.
17.2.b.
Conditions of issuance. Eligible candidate must hold a valid Permanent Resident
Card, Employment Authorization Document (EAD), or work permit issued by the
United States Citizenship and Immigration Services (USCIS) as per W. Va. Code
§
18A-3-1, and must meet the
following criteria:
17.2.b.1. provide evidence
of a foreign credential evaluation by a WVDE-approved foreign credential
evaluation agency that the candidate has completed the equivalent of an
approved educational personnel preparation program in the United States and in
a specialization offered in West Virginia (see Appendix A), with or without the
required tests in pre-professional skills, Content and/or Professional
Education, or when the candidate holds the necessary credentials in another
country to teach in the public schools of that country, and the candidate has
completed a degree equivalent to the required degree level in the United States
and has earned an overall GPA equivalent to a 2.50 in the United States if
applicable.
17.2.c.
Renewal of the Permit for Non-United States Citizen. To renew the Permit for
Non-United States Citizen, must meet requirements as listed in section
10.4.a.1; and
17.2.c.1. Candidate must
continue to hold valid Permanent Resident Card, Employment Authorization
Document (EAD), or work permit issued by the United States Citizenship and
Immigration Services (USCIS) as per W. Va. Code §
18A-3-1.
17.2.c.2. Upon acquisition of United States
citizenship or meeting the conditions specified in section 10, the candidate
may apply for the Initial Professional Teaching Certificate.
17.2.d. Validity. The Permit for
Non-United States Citizen shall be valid for one school year and may be renewed
once.
