Title 126 - PROCEDURAL RULE BOARD OF EDUCATION
Series 126-094 - Procedures for the Collection, Maintenance, and Disclosure of Student Data (4350)
Section 126-94-1 - General

1.1. Scope. -- This procedural rule sets forth the requirements for the collection, maintenance, and disclosure of student data in West Virginia public schools.

1.1.a. County/Counties. For purposes of this rule, county includes county boards of education, schools and facilities under the supervision of the West Virginia Board of Education (WVBE), and charter public schools.

1.2. Authority. -- W. Va. Constitution, Article XII, §2; W. Va. Code § 18-2-5; Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99); Individuals with Disabilities Education Act (IDEA) (20 U.S.C. § 1400); Every Student Succeeds Act (20 U.S.C. § 6301, et seq.); National Defense Authorization Act for the Fiscal Year 2002 ( Public Law 107-107); and their respective regulations.

1.3. Filing Date. -- May 12, 2022.

1.4. Effective Date. -- June 13, 2022.

1.5. Repeal of Former Rule. -- This procedural rule amends W. Va. 126CSR94, Policy 4350, Procedures for the Collection, Maintenance and Disclosure of Student Data (Policy 4350), filed September 8, 2016, and effective October 11, 2016.
