Section 126-85-109 - Civil Rights Definitions

109.1. Grassroots Organization - Any organization at the local level that interacts with potential participants, such as a community program, civic organization, migrant group, church, neighborhood council, local chapter of the National Association for the Advancement of Colored People or other similar groups.

109.2. Minority - A person or group of persons belonging to the protected classes covered by Title VI of the Civil Rights Act of 1964, as amended, and later specified by the OMB as: American Indian or Alaskan Native, Asian or Pacific Islander, Black (not of Hispanic Origin) or Hispanic.

109.3. Racial/Ethnic Categories - The designation of participants/potential participants by race, color or national origin from the collection and reporting of racial/ethnic data as follows:

109.3.1. American Indian or Alaskan Native-A person having origins in the original peoples of North America, and who maintains cultural identification through tribal affiliation or community recognition.

109.3.2. Asian or Pacific Islander - A person having origins in any of the original peoples of the Far East, Southeast Asia, the Indian Subcontinent, or the Pacific Islands. This area includes, for example, China, India, Japan, Korea, the Philippine Islands and Samoa.

109.3.3. Black (not of Hispanic Origin) - A person having origins in any of the black racial groups of Africa.

109.3.4. Hispanic - A person of Mexican, Puerto Rican, Cuban, Central or South American or other Spanish culture or origins, regardless of race.

109.4. Complaint-A verbal or written allegation of discrimination that indicates that any NSLP, SBP or SMP is administered or operated in such a manner that it results in disparity of treatment, benefits or services being provided to a child or group of children because of their race, color, national origin, gender, age or disability.
