(1) The WISH Act prohibits employers from discriminating against an employee for reporting a work-related fatality, injury or illness. It also protects the employee who files a safety and health complaint, or asks for access to chapter 296-27 WAC records , or otherwise exercises any rights afforded under this act.

(2) DOSH may not issue an injury and illness record-keeping variance to a private sector employer. However, DOSH must recognize all recordkeeping variances issued by federal OSHA.

(3)DOSH may only grant an injury and illness recording and reporting variance to a state or local government employer within the state after obtaining approval to grant the variance from federal OSHA.
