Section 173-220-200 - Transfer of permit

(1) A permit is automatically transferred to a new discharger if:
(a) A written agreement between the old and
new discharger containing a specific date for transfer of permit
responsibility, coverage, and liability is submitted to the director;
and
(b) The director does not
notify the old and new discharger of his/her intent to modify, or revoke and
reissue the permit. If this notice is not given, the transfer is effective on
the date specified in the agreement mentioned in (a) of this
subsection.
(2) Unless a permit is automatically transferred according to subsection (1) of this section, a permit may be transferred only if modified or revoked and reissued to identify the new permittee and incorporate such other requirements as may be necessary.
