Section 9VAC5-80-1955 - Significant amendment procedures

A. The criteria for use of significant amendment procedures are as follows:

A request for a significant permit amendment shall include a description of the change, the emissions resulting from the change, and any new applicable regulatory requirements that will apply if the change occurs. The applicant may, at the applicant's discretion, include a suggested draft permit amendment.
C. The provisions of 9VAC5-80-1775 shall apply to requests made under this section.
D. The department will normally take final action on significant permit amendments within 180 days after receipt of a complete request. The department may extend this time period if additional information is needed.
E. The owner shall not make the change applied for in the significant amendment request until the amendment is approved by the department under subsection D of this section.
