Section 9VAC5-80-1825 - Innovative control technology

A. Prior to the close of the public comment period under 9VAC5-80-1775, an owner of a proposed major stationary source or major modification may request, in writing, that the department approve a system of innovative control technology.
B. The department, with the consent of the governor(s) of affected state(s), will determine that the source or modification may employ a system of innovative control technology, if:
C. The department will withdraw any approval to employ a system of innovative control technology made under this article, if:
D. If a source or modification fails to meet the requirement level of continuous emission reduction within the specified time period or the approval is withdrawn in accordance with subsection C of this section, the department may allow the source or modification up to an additional three years to meet the requirement for the application of best available control technology through use of a demonstrated system of control.
