AGENCY SUMMARY

The Virginia Indigent Defense Commission, formerly the Public Defender Commission, is an independent judicial agency. The commission represents (i) indigent persons charged with crimes or offenses when such persons are entitled by law to be represented by court-appointed counsel in a court of record or a court not of record, (ii) indigent persons who are entitled to be represented by court-appointed counsel in appeals of their convictions to the Court of Appeals or the Supreme Court of Virginia, and (iii) indigent prisoners when a habeas corpus proceeding is brought by such prisoners. Code of Virginia, Title 19.2, Chapter 10, Articles 3.1 and 4.

The commission and the Supreme Court, in conjunction with the Virginia State Bar, is required to adopt standards for attorneys admitted to practice law in Virginia who are qualified to represent defendants charged with capital murder or sentenced to death and to maintain a list or lists of attorneys admitted to practice law in Virginia who are qualified to represent defendants charged with capital murder or sentenced to death.
