AGENCY SUMMARY

The Board of Corrections is authorized to establish operational and fiscal standards governing the operation of local, regional, and community correctional facilities and establish regulations for provision of educational and vocational programs within the Department of Corrections. Code of Virginia, Title 53.1, Chapter 1, Article 2. The Director of Corrections is authorized to supervise and manage the Department of Corrections and its system of state correctional facilities and to implement the standards and goals of the board as formulated for local and community correctional programs and facilities and lock-ups. Code of Virginia, Title 53.1, Chapter 1, Article 3.

The Board is required to establish minimum standards for the construction, equipment, administration and operation of local correctional facilities and lockups. Code of Virginia, Title 53.1, Chapter 3, Articles 1, 1.1 and 8. It is authorized to promulgate regulations for evaluating requests from cities or counties for reimbursement of board-approved jail construction, enlargement or renovation. Code of Virginia, Title 53.1, Chapter 3, Article 3. The board is responsible for promulgating regulations for the conduct of human research to be conducted or authorized by the department. Code of Virginia, Title 53.1, Chapter 1, Article 2. The director, with the prior approval of the Governor, may enter into agreements with a public or private entity to operate a work program in a state correctional facility for prisoners confined therein. Code of Virginia, Title 53.1, Chapter 2, Article 3.

The board is authorized to prescribe standards for the development, implementation, operation, and evaluation of programs, services and facilities for a statewide community-based corrections system for state-responsible offenders. Code of Virginia, Title 53.1, Chapter 2, Article 6.

The board is authorized to promulgate regulations governing the private management and operation of prison facilities. Code of Virginia, Title 53.1, Chapter 15.

The director is given some rulemaking authority concerning state correctional institutions, which in some instances is subject to board approval. Among these are the authority to prescribe rules for the preservation of state property and the health of prisoners in state correctional facilities (Chapter 2, Article 1) and to provide offender work and vocational training opportunities and pay incentives subject to rules and regulations of the board (Chapter 2, Article 3). Code of Virginia, Title 53.1, Chapters 1, 2, 3, 5, and 6.

The director is authorized to establish and maintain a system of halfway houses for the temporary care of eligible adults who are placed on probation or released on parole with minimum standards for the operation of the facilities established by the board. Code of Virginia, Title 53.1, Chapter 5, Article 1.

The department is authorized to establish and maintain a system of residential diversion and detention centers for probationers who require more security and supervision than provided by intensive probation and parole supervision. Code of Virginia, Title 53.1, Chapter 2, Article 7.

The director is authorized to carry out all orders and rules and regulations adopted by the Parole Board and to direct and supervise the work of probation and parole officers who supervise adults on probation or parole and make investigations as requested by the courts. Code of Virginia, Title 53.1, Chapter 4, Article 1.

All educational facilities within department institutions are operated by the Division of Education under the supervision of a superintendent employed by the director. Code of Virginia, Title 53.1, Chapter 1, Article 3.
