Section 4VAC25-160-150 - Effective dates for and enforcement of board orders

A. All orders issued by the board under § 45.2-1619 of the Code of Virginia shall remain in effect until vacated or amended by the board on its own motion or on application from an owner or operator in the field or unit subject to the order.

B. Unless otherwise provided in the board order, all orders issued by the board under §§ 45.2-1620 and 45.2-1622 of the Code of Virginia shall remain in effect:

1. For a period of two years from the date of issuance of the board order;

2. If a permit has been issued for a well in a unit subject to the order, until the permit or permits have expired or been released on the well or wells; or

3. Until vacated or amended by the board on its own motion or on application.

C. In the event that an appeal is taken from any order of the board, the time between the filing of the petition for appeal and the final order of the circuit court shall be excluded in calculating the time period as contained in subsection B of this section.

D. All orders of the board shall be enforced by the director pursuant to the process set out in this chapter and § 45.2-1626 of the Code of Virginia.
