Section 4VAC15-90-291 - Enclosed or fenced areas that prevent or impede the free egress of deer

A. Pursuant to § 29.1-525.1A and B of the Code of Virginia, an enclosed or fenced area having any of the following attributes shall be deemed to prevent or impede the free egress of deer:

1. A fence greater than 61 inches high anywhere along its entire length;

2. A fence greater than 61 inches high that incorporates any topographic or other physical barrier that prevents or impedes the free egress of deer; or

3. A fence or other barrier 61 inches or less in height having any attribute that prevents or impedes the free egress of deer, including being slanted, doubled, offset, or electrified.

B. This section shall not apply to enclosures and lands exempted under § 29.1-525.1C and D of the Code of Virginia.

C. The director or his designee may grant exceptions for an enclosed or fenced area having any of the above attributes where necessary for bona fide agricultural livestock operations.
