If a person denies access to the authorized representative of the commissioner, the authorized representative shall:
1. Inform the person that:
a. The person is required to allow access to
the authorized representative as specified under
2VAC5-585-3820;
b. The department will refer the matter to
the Commonwealth's Attorney for handling in accordance with applicable sections
of the Code of Virginia; and
2. Make a final request for access.
