Section 20 021 001 - CRITERIA FOR CONSIDERING NEW MILK HANDLER LICENSE APPLICATIONS

(VSA Title 6, Section 2721, 2722 & 2722A)

The Commissioner will consider the following criteria in determining whether licensing of new milk handlers in Vermont will promote the general good of the dairy industry and the consuming public.

1) Area population to be served

2) Adequacy of existing milk handler facilities and service

3) Economic impact of a new milk handler to the extent that:

1. Dairy farmers in the area to be served continue to have a viable market for their milk.

2. Milk handlers in the area to be served will not experience competition which could result in serious losses that may threaten their future existence and the loss of jobs to people in the community.

3. Consumers in the area to be served will experience a balance of competition to maintain fair and just product pricing.

4) Convenience and necessity for consuming public

5) Applicant's character, experience, facilities, and service to consumers

6) Anticipated effect on the dairy industry and consuming public

7) Nature of the product to be sold
