Rule R527-250 - Emancipation and a Child's Age of Majority

(1) The Department of Human Services is authorized to create rules necessary for social services pursuant to Section 62A-1-111. The Office of Recovery Services (ORS) is authorized to adopt, amend, and enforce rules pursuant to Section 62A-11-107.
(2) The purpose of this rule is to establish how ORS determines the appropriate emancipation date for IV-D child support cases, particularly when determining the child's normal and expected year of graduation referenced in Section 78B-12-219 for child support orders issued on or after July 1, 1994. This rule also clarifies a child's age of majority as described in Section 78B-5-202 to be used when ORS determines the duration of a judgment for past due support.
