Rule R527-200 - Administrative Procedures
Section R527-200-1 - Authority and Purpose

(1) The Department of Human Services is authorized to create rules necessary for social services pursuant to Section 62A-1-111. The Office of Recovery Services (ORS) is authorized to adopt, amend, and enforce rules pursuant to Section 62A-11-107.
(2) The purpose of this rule is to establish procedures for informal adjudicative proceedings pursuant to Section 63G-4-203. This rule:
(a) establishes the form of
proceedings;
(b) provides
procedures for requesting and obtaining a hearing when a proceeding is
initiated by a notice of agency action;
(c) provides procedures and standards for
orders resulting from the administrative process;
(d) provides procedures for informal
proceedings;
(e) provides
procedures for the conduct of hearings and other informal adjudicative
proceedings;
(f) provides
procedures for requesting reconsideration;
(g) provides procedures for a motion to set
aside a default order;
(h) provides
procedures for amending an administrative order;
(i) provides procedures for setting aside an
administrative order; and
(j)
Provides procedures for requesting a judicial review.
